STATE OF GEORGIA COUNTY OF GILMER NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in a Deed to Secure Debt dated 22ND day of SEPTEMBER,2015, from MARY L. MILLER to JOHNNY J. JONES REALTY, INC., recorded in Deed Book 1938, Page 127-131, said Deed to Secure Debt having been given to secure a promissory note of even date, in the original principal sum of $38,000.00, and interest from date as stated therein; the holder thereof will offer the property described below for sale at public outcry to the highest bidder for cash before the courthouse door at GILMER COUNTY, GEORGIA within the legal hours of sale on the first Tuesday in MAY,2016 The property is described as follows: All that tract or parcel of land lying and being in Land Lot 178. 11th District, 2nd Section, of Gilmer County, Georgia Lot 16B, consisting of 1.15 acres, more or less, as shown on plat of survey for Tim Hedden. Said plat. dated May 14, 2001, by Joel Jordan, Georgia Registered Land Surveyor No. 2430, is recorded in Plat Book 36, Page 273, Gilmer County Records, with reference made thereto for the purpose of incorporating same. Property is subject to all easements and right-of ways as shown on the within-cited plats. As described in Deed Book 797, Page 228, Further described as Map & Parcel 3053AA 009 split. Also conveyed is a permanently affixed 2000 doublewide mobile home with the serial number of C01588AB GA and all improvements placed on the property. This is the same property that was bought at a Tax Sale on May 7,2013. The Tax Sale Deed is recorded in Deed Book 1809, page 60-61, of the Gilmer County Records. The debt secured by said Deed to secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees. To the best information, knowledge and belief of the undersigned, the property is presently in the possession of MARY L. MILLER. The property will be sold as the property of said MARY L. MILLER and will be sold subject to all restrictions, liens, encumbrances, easements and other matter of record, if any, to which the Deed to Secure Debt is junior and inferior in terms of priority, and subject to any and all unpaid taxes of assessments relating to the property.
