GEORGIA, GILMER COUNTY NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT By virtue of the Power of Sale contained in a Deed to Secure Debt dated March 27, 2012, from Jon Pfiel to Johnny J. Jones, and recorded in Deed Book 1723, page 275, Gilmer County Records; said Deed to Secure Debt being given to secure a promissory note of even date, in the original principal amount of $4,700.00, with interest from date as stated therein; the holder thereof, Johnny J. Jones Realty, Inc., transferee by instrument recorded in Deed Book 1914, page 54, Gilmer County Records, will offer the property described below for sale at public outcry to the highest bidder for cash before the courthouse door at Gilmer County, Georgia, within the legal hours of sale on the first Tuesday in June, 2016. The property is described as follows: All that tract or parcel of land lying in the 11th District, 2nd Section of Gilmer County, Georgia and a part of Land Lots 103 designated as Lot C-187 of Eagles Mountain Resort Unit 52, as shown on survey of Burns L. Jeffries, RLS#2036, dated May 1, 1986 and recorded in Plat Book 14, Page 69, Gilmer County Records to which reference is hereby made for a more complete metes and bounds description as provided by Section 44-2-28 Official Code of GA Ann. (29-423 GA Code Ann.). This Conveyance is subject to the covenants and restrictions as set forth in a document recorded May 17, 1984 in Deed Book 138, Page 448, Gilmer County Records. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale including attorney's fees. To the best information, knowledge and belief of the undersigned, the property is presently in the possession of Jon Pfiel. The property will be sold as the property of said Jon Pfiel, and will be sold subject to all restrictions, liens, encumbrances, easements and other matters of record, if any, to which the Deed to Secure Debt is junior and inferior in terms of priority, and subject to any and all unpaid taxes or assessments relating to the property.
