STATE OF GEORGIA COUNTY OF GILMER NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain security deed given by Michael J. Sapp and Stacey L. Sapp to Regions Bank dated February 27, 2004, filed for record in Book 1041, Page 315, Gilmer County, Georgia Records; as assigned by the Regions Bank to RREF II RB Acquisitions, LLC pursuant to an assignment filed for record in Book 1835, Page 154, Gilmer County, Georgia Records; as assigned by RREF II RB Acquisitions, LLC to RREF II RB-GA MJS, LLC pursuant to an Assignment of Security Deed filed for record in Book 1887, Page 442, Gilmer County, Georgia Records (collectively, the Security Deed), said Security Deed having been given to secure a Promissory Note in the original principal sum of Three Hundred Fifty Thousand and No/100 Dollars ($350,000.00), with interest at the rate stated in said Note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Gilmer County, Georgia, between the hours of 10:00 a.m. and 4:00 p.m. on June 7, 2016, the following described property: All that tract or parcel of land lying in Land Lot 117 & 136, 11th District, 2nd Section, Gilmer County, Georgia, containing 2.12 acres, as more fully described on plat of survey for Mike J. Sapp and Stacey L. Sapp, dated January 8, 2004 by Mark E. Chastain, GRLS # 2718, as recorded in Plat Book 39, page 192, Gilmer County Records to which reference is hereby made for a more complete and accurate legal description; together with all improvements located thereon including a store building and all other buildings and structures. The debt secured by the herein described Security Deed has been declared due because of, among other possible events of default, failure to pay the indebtedness when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys fees. The entity that has full authority to negotiate, amend, and modify all terms of the Security Deed with the debtor is RREF II RB-GA MJS, LLC, Attention: Leslie P. Please understand that the secured creditor is not required to negotiate, amend, or modify the terms of the Security Deed. Said property will be sold subject to any outstanding ad valorem taxes (including taxes that are a lien, but not yet due and payable); matters that may be disclosed by an accurate survey and/or inspection of the property; all assessments, liens, encumbrances, zoning ordinances, easements, covenants and restrictions; and any matters of record superior to this Security Deed.
