NOTICE OF FORECLOSURE SALE UNDER POWER
Ben Hill County, Georgia, THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
Under and by virtue of the Power of Sale contained in a Security Deed given by Daniel G. Chaney and Heather D. Chaney to Mortgage Electronic Registration Systems, Inc. as nominee for EquiFirst Corporation, dated January 9, 2008, and recorded in Deed Book 00688, Page 00265, Ben Hill
County, Georgia Records, as last transferred to Christiana Trust, a division of Wilmington Savings Fund Society, FSB, as Indenture Trustee
with respect to NRPL Trust 2013-1 by assignment recorded on February 11, 2016 in Book 00887 Page 00200 in the Office of the Clerk of Superior Court of Ben Hill County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Sixty-Three Thousand Eight Hundred Forty and 0/100 dollars ($63,840.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Ben Hill County, Georgia, within the legal hours of sale on June 7, 2016, the following described property:
All of Lot Number Twenty-four (24) in Roanoke Acres Number Twelve (12) as shown by plat of said subdivision prepared by D. E. Deese and S. Y. A. Ball dated July 19, 1973, recorded in the office of the Clerk of the Superior Court of Ben Hill County, Georgia, in Plat Book 5, Page 152. Said lots are located in the City of Fitzgerald and said subdivision is a subdivision of Five Acre Tracts Numbers Four Hundred Ninety-four (494), Four Hundred Ninety-five (495), Four Hundred Ninety-six (496) and a portion of Four Hundred Ninety-seven (497) in Land Lot Number One Hundred Twenty-two (122) in the Third Land District of Ben Hill County, Georgia. Said Five Acre Tracts are shown on the plat of the Colony Domain of the American Tribune Soldiers Colony Company of file in the office of the Clerk of the Superior Court of Irwin County, Georgia. Said lot fronts 105 feet on Duane Drive West and extends in a Westerly direction an even width of 107 feet.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
The entity having full authority to negotiate, amend or modify all terms of the loan (although not required by law to do so) is: Seneca Mortgage Servicing, LLC they can be contacted at (866) 919-5600 for Loss Mitigation Dept, or by writing to 611 Jamison Road, Elma, New York 14059, to discuss possible alternatives to avoid foreclosure.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is Daniel G. Chaney and Heather D. Chaney or tenant(s); and said property is more commonly known as 137 Duane Drive, Fitzgerald, GA 31750.
The sale will be conducted subject to (1) confirmation that the sale is
not prohibited under the U.S. Bankruptcy Code (2) final confirmation
and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
