CLASS:007 NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF COWETA Because of a default in the payment of the indebtedness secured by a Security Deed executed by Kanku K. Ngalula and Melrose D. Allen-Ngalula to LaGrange Banking Company n/k/a Calumet Bank dated January 31, 2011, and recorded in Deed Book 3644, Page 445-453, Coweta County Records, securing a Note dated January 31, 2011 in the original principal amount of $990,810.00 as subsequently modified by the parties, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in said Deed, will on the first Tuesday, May 3, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to wit: TRACT 1 – ACQUISITION PROPERTY: All that tract or parcel of land lying and being in Land Lots 240 and 241 of the 2nd Land District, being identified as Tract 1, containing 17.18 acres and being more particularly shown on plat of survey prepared by Statewide Surveying Company, certified by E. Kirby Holton, Georgia Registered Land Surveyor No. 2944, dated September 27, 2010, entitled “Survey for Monte R. Sharp” and recorded in Plat Book 90, Page 335, Coweta County, Georgia records. Said plat and record thereof are by reference incorporated herein for a more complete description. Together with and subject to that certain 60 foot “Access Easement” as shown on the West side of Tract 2 on the above referenced survey plat for the purpose of ingress and egress for vehicular and pedestrian traffic for the benefit of the owners of Tract 1 as shown on said plat for ingress and egress to and from the said Tract 1 to Grandma Branch Road. Said property is known as 540 Alexander Road, Grantville, GA 30220, together with all fixtures and personal property attached to and constituting a part of said property, if any. TRACT 2 – ADDITIONAL COLLATERAL: All that tract or parcel of land lying and being in Land Lots 240 and 241 of the 2nd Land District, being identified as Tract 2, containing 24.37 acres and being more particularly shown on plat of survey prepared by Statewide Surveying Company, certified by E. Kirby Holton, Georgia Registered Land Surveyor No. 2944, dated September 27, 2010, entitled “Survey for Monte R. Sharp” and recorded in Plat Book 90, Page 335, Coweta County, Georgia records. Said plat and record thereof are by reference incorporated herein for a more complete description. Subject to that certain 60 foot “Access Easement” as shown on the West side of Tract 2 on the above referenced survey plat for the purpose of ingress and egress for vehicular and pedestrian traffic for the benefit of of the owners of Tract 1 as shown on said plat for ingress and egress to and from the said Tract 1 to Grandma Branch Road. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said Deed. Said property will be sold as the property of Kanku K. Ngalula and Melrose D. Allen-Ngalula, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Kanku K. Ngalula and Melrose D. Allen-Ngalula or a tenant or tenants, and the proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale, including attorney's fees, all as provided in said Deed, and the balance, if any, will be distributed as provided by law.
