NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY By virtue of the power of sale contained in the undated Deed to Secure Debt ("Security Deed") from Jeffrey S. Guest and Lisa A. Guest to Ameris Bank recorded in the public records of Glynn County, Georgia, at Deed Book 1597, page 183, modified by instruments dated September 30, 2005, recorded in Deed Book 1793, page 442; dated December 8, 2005, recorded in Deed Book 1942, page 89; dated January 29, 2009, recorded in Deed Book 2566, page 275; and dated September 30, 2014, recorded in Deed Book 3355, page 352, aforesaid records; securing a Note dated January 29, 2009, in the original principal amount of $123,689.25, renewed on September 20, 2011, and September 30, 2014, and a Note dated September 30, 2014, in the original principal amount of $186,814.30, there will be sold by the undersigned at public outcry, during the legal hours of sale before the Courthouse door of Glynn County, Georgia, on the first Tuesday in April, 2016, to the highest and best bidder for cash, the following described property: All that certain lot, tract or parcel of land situate, lying and being in the City of Brunswick, Glynn County, Georgia, and containing 10,284.75 square feet, which is more particularly described according to a plat of survey prepared by James L. Conine, Georgia Registered Land Surveyor No. 1545, entitled "Clarence F. Gibson, Portion of Tract VII, Brunswick Mall, Brunswick, Glynn County, Georgia", dated July 22, 1987 and recorded in the office of the Clerk of Superior Court of Glynn County, Georgia in Deed Book 33-H, page 104 and re-recorded in Deed Book 34-B, page 86, and more specifically described as follows, to-wit: To locate the point of beginning, from the intersection of the eastern right-of-way line of Altama Avenue with the southern right-of-way line of Cypress Mill Road, thence proceeding South 12 30' 00" West along the eastern right-of-way line of Altama Avenue 450.00 feet to an iron pin; thence proceeding South 77 30' 00" East 196.00 feet to a railroad spike which is the point of beginning of the tract herein described and conveyed; thence proceeding South 77 30' 00" East 195.9 feet to a railroad spike; thence proceeding South 12 30' 00" West 52.5 feet to an iron pin; thence proceeding North 77 30' 00" West 195.9 feet to an iron pin; thence proceeding North 12 30' 00" East 52.5 feet to a railroad spike which is the point of beginning of the tract herein described and conveyed. This tract is shown and described according to plat of survey by Robert N. Shupe, Georgia Registered Land Surveyor No. 2224, dated October 6, 1993, and entitled "J. Melvin Dees, Jr." Reference is hereby made to the aforesaid plat and to the record thereof for all purposes of description and identification and for all other purposes allowed by law. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the installments under said Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by said Security Deed, accrued interest and expenses of the sale, including attorney's fees. To the best of the undersigned's knowledge and belief the property is in the possession of Jeffrey S. Guest, Lisa A. Guest and Jeffrey S. Guest, Inc. Said property will be sold as the property of Jeffrey S. Guest and Lisa A. Guest, subject to any outstanding ad valorem taxes, assessments, and liens or interests superior to the Security Deed first set out above. The undersigned will execute a deed to the purchaser at said sale as provided in said Security Deed.
