NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY By virtue of the power of sale contained in the Deed to Secure Debt and Security Agreement dated August 26, 2009, from T. Holmes Ramsey, Jr. ("Grantor") to Branch Banking and Trust Company ("BB&T"), recorded September 11, 2009, at Deed Book 2632, page 446, Glynn County, Georgia, Superior Court Records, last assigned to LSCG Fund 2, LLC ("Lender") on April 5, 2012, by Transfer and Assignment of Security Deed and Loan Documents, recorded January 28, 2014, at Deed Book 3269, Page 141, said records (collectively, "Security Deed"), given to secure Grantor's Guaranty Agreement with BB&T, dated June 26, 2009, for a Note dated May 19, 2006 from Tillman Park, LLC to BB&T ("Note"), as modified, and last extended by Forbearance Agreement effective February 26, 2015, in the principal amount of $5,170,035.63, as amended, last assigned to Lender (collectively, "Indebtedness"), and other indebtedness, there will be sold by the undersigned at public outcry, during the legal hours of sale before the Courthouse door of Glynn County, Georgia, at Brunswick, Georgia, on the first Tuesday in April, 2016, to the highest and best bidder for cash, the following described property ("Property"): All of that certain lot, tract or parcel of land situate, lying and being on Jekyll Island, in Glynn County, Georgia, and being further described as ALL OF LOT NUMBERED FIVE (5), OF BLOCK LETTERED "N", OF JEKYLL BEACH SUBDIVISION, according to a plat of Jekyll Island State Park Authority showing Jekyll Beach Subdivision (a copy of said plat being of file and record in the office of the Clerk of the Superior Court of Glynn County, Georgia in Plat Drawer 1, as Map No. 28, and a copy being of file in the office of the Jekyll Island State Park Authority in Atlanta, Georgia and on Jekyll Island, Georgia). This being the same real property conveyed by that certain warranty deed dated October 1, 1984, from Dorothy M. Lilly to Sylvia S. Jorgeson, recorded in said Clerk's office in Deed Book 25-I, Page 318, said deed having been executed by Alfred S. Lilly, Jr., as attorney in fact for the said Dorothy M. Lilly, pursuant to Power of Attorney recorded in said Clerk's office in Deed Book 18-M, Page 258. Together with all buildings, structures and other improvements of every kind and nature whatsoever now or hereafter situated on the Land; and all machinery, equipment, fixtures, appliances and building, construction, development and landscaping supplies and materials now or hereafter placed on or in the Land; and all of the things addressed in this paragraph, whether generally or specifically, shall be deemed to be fixtures and accessions to the freehold and a part of the Land as between the parties hereto and all persons claiming, by, through or under them; and All and singular the easements, rights-of-way, strips and gores of land, streets, ways, alleys, passages, sewer rights, waters, water courses, water rights and powers, estates, rights, titles, interests, minerals, royalties, privileges, liberties, tenements, hereditaments and appurtenances whatsoever, in any way now or hereafter belonging, relating or appertaining to the Land or the improvements now or hereafter located thereon, or any part thereof, whether now owned or hereafter acquired by Grantor, and the reversion or reversions, remainder and remainders, rents, issues and profits thereof; and all right to receive excess payments in any tax sale of the Land and the improvements now or hereafter located thereon, or any part thereof; and all the estate, right, title, interest, claim and demand whatsoever of Grantor of, in and to the same. SUBJECT TO: Jekyll Island - State Park Authority Residential Property Lease dated July 28, 1958, recorded at Deed Book 8-V, Page 53, Glynn County, Georgia records, as amended and restated on October 13, 2010, recorded November 3, 2010, at Deed Book 2789, Page 46, said records. As well as other possible defaults, the debt secured by said Security Deed has matured and has not been paid. The debt remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by said Security Deed, accrued interest and expenses of the sale, including attorney's fees. To the best of the undersigned's knowledge and belief the Property is in the possession of T. Holmes Ramsey, Jr., or his tenant, and said Property will be sold as his property, subject to any outstanding ad valorem taxes, assessments, and liens or interests superior to the Security Deed first set out above. The undersigned will execute a deed for the Property to the purchaser at said sale as provided in said Security Deed. The following information is being provided in accordance with OCGA 44-14-162.2.
