gpn14 HS Foreclosures NOTICE OF SALE UNDER POWER IN SECURITY DEED By virtue of the power of sale contained in that certain Promissory Note and Security Deed from ASHLEY MATIAS and CARLOS MATIAS (Grantors) to BRANDON OLSON (Grantee), dated October 1, 2014, and is recorded in Deed Book 445, folio 225-237, in the Office of the Clerk of the Superior Court of Long County, Georgia, the undersigned will sell at public outcry to the highest bidder for cash before the door of the courthouse of the Superior Court of Long County, Georgia, located in Ludowici, Georgia, within the legal hours of sale, on Tuesday, April 5, 2016 the following described property: All that lot, tract or parcel of land situate, lying and being in the 1756th G. M. District of Long County, State of Georgia, and being known as Lot 33 Huckleberry Subdivision (sometimes referred to as Huckaberry Subdivision), according to a plat of survey made by John O. Parker, Georgia Registered Land Surveyor No. 1850, dated January 27, 2005 and recorded in Plat Book 16, Page 112 in the Office of the Clerk of Superior Court of Long County, Georgia, which plat is by reference incorporated herein for descriptive and all other purposes; together with all fixtures, outbuildings and improvements thereon including, without limitation, one (1) 2005 64 foot x 28 foot Destiny Southern Pines Manufactured Home, Serial No. DISHS00800AB, which is permanently attached thereto, and all appliances, fixtures and window treatments therein. This is the same property conveyed by Brandon Olson by Special Warranty deed dated October 26, 2011 and recorded in Deed Book 373, Pages 268-270 in the Office of the Clerk of Superior Court of Long County, Georgia. Said Property is currently known as 135 Willow Lane, NE, Ludowici, Georgia 31316. The debt secured by said Promissory Note and Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, nonpayment of the installments on said contract. Because the debt remains in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys' fees. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. Notice has been given of intention to collect attorney's fees in accordance with the terms of the note secured by said deed. Said property will be sold as the property of ASHLEY MATAIS and CARLOS MATIAS, JR., subject to the terms and conditions of said Promissory Note, their heirs, executors, administrators, successors, and assigns, subject to (1) all covenants, easements, rights-of way and restrictions or encumbrances of record; (2) matters which would be disclosed by survey; (3) zoning ordinances; and (4) ad valorem taxes and assessments which may constitute liens against the property, whether or not due and payable and the proceeds of said sale will be applied to the payment of said indebtedness, the expense of said sale, all as provided in said deed, and the undersigned will execute a deed to the purchaser as provided in the aforementioned Security Deed.
