gpn14 BC Foreclosures STATE OF GEORGIA COUNTY OF BRYAN NOTICE OF SALE UNDER POWER Because of default in the payment of the indebtedness secured by that certain Security Deed given by FLOYD MURRAY and LLOYD D. MURRAY, SR. (Lloyd D. Murray, Sr., being hereinafter "Borrower") to FIRST BANK OF COASTAL GEORGIA ("Lender"), dated August 5, 2005, and recorded in Deed Book 539, Page 0188, Bryan County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of ONE MILLION FIVE HUNDRED THOUSAND AND NO/100 DOLLARS ($1,500,000.00) along with other loans between Borrower and Lender also secured by the hereinafter described property, as the same may have been extended, renewed and modified, as well as other possible events of default, said Lender has declared the entire amount of the said indebtedness immediately due and payable and pursuant to the power of sale contained therein will on the first Tuesday in April, to wit: April 5, 2016, during the legal hours of sale at the Courthouse Door in Bryan County, Georgia, sell to the highest bidder for cash the property described in said Security Deed, to wit: TRACT ONE: All that certain lot, tract or parcel of land situate, lying and being in Bryan County, Georgia, in the 20th G.M. District, containing 27.242 acres, and being more particularly described on that certain plat prepared by Joe P. Davis, Georgia Registered Land Surveyor No. 1436, dated December 11, 12, 13, 1980, and recorded in the Office of the Clerk of Superior Court of Bryan County, Georgia, in Plat Slide 284, Page 90. Said plat referred to herein is hereby incorporated by specific reference for descriptive and all other legal purposes. TRACT TWO: All that certain lot, tract or parcel of land situate, lying and being in Bryan County, Georgia, in the 20th G.M. District, containing 0.360 acres, and being designated as Area "D" on that certain plat prepared by Joe P. Davis, Georgia Registered Land Surveyor No. 1436, dated December 9, 1983, and recorded in the Office of the Clerk of Superior Court of Bryan County, Georgia, in Plat Slide 384, page 4. Said plat referred to herein is hereby incorporated by specific reference for descriptive and all other legal purposes. TRACT THREE: All that certain lot, tract or parcel of land situate, lying and being in Bryan County, Georgia, in the 20th G.M. District, containing 0.123 acres, and being designated as Area "A" on that certain plat prepared by Joe P. David, Georgia Registered Land Surveyor No. 1436, dated December 9, 1983, and recorded in the Office of the Clerk of Superior Court by Bryan County, Georgia, in Plat Slide 384, page 4. Said plat referred to herein is hereby incorporated by specific reference for descriptive and all other legal purposes. Reference is made to deeds of record in the Office of the Clerk of Superior Court of Bryan County, Georgia, wherein the said Floyd Murray acquired the property described herein. Said deeds are recorded in Deed Book 3-I, Page 281; Deed Book 3-Q, Page 130; Deed Book 3-Q, Page 185; Deed Brook 3-Q, Page 186; and Deed Brook 4-E, Page 628. SUBJECT to all valid reservation, restrictions, easements and rights of way of record. TOGETHER with all improvements located thereon. Each person attending the sale will be afforded an opportunity to bid on a competitive basis. The Lender has the right to bid at the sale and may be the purchaser of the property. Said Property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, the right of redemption of any taxing authority, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The property will be sold as the property of LLOYD D. MURRAY and RANDY B. MURRAY, which to the best of the undersigned's knowledge and belief is the party or parties in possession of the aforementioned property. All proceeds of the sale will be applied to the payment of said indebtedness, the expenses of said sale, including attorney's fees (notice of intent to collect attorney's fees having been given), all as provided in the Security Deed, and the undersigned will execute a Deed Under Power to the purchaser at the sale as provided for in said Security Deed.
