gpn14 BC Foreclosures STATE OF GEORGIA COUNTY OF BRYAN NOTICE OF SALE UNDER POWER Because of default in the payment of the indebtedness secured by that certain Security Deed given by LLOYD D. MURRAY, SR. ("Borrower") to FIRST BANK OF COASTAL GEORGIA ("Lender"), dated February 23, 2005, and recorded in Deed Book 495, Page 0015, Bryan County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of ONE MILLION FIVE HUNDRED THOUSAND AND NO/100 DOLLARS ($1,500,000.00) along with other loans between Borrower and Lender also secured by the hereinafter described property, as the same may have been extended, renewed and modified, as well as other possible events of default, said Lender has declared the entire amount of the said indebtedness immediately due and payable and pursuant to the power of sale contained therein will on the first Tuesday in April, to wit: April 5, 2016, during the legal hours of sale at the Courthouse Door in Bryan County, Georgia, sell to the highest bidder for cash the property described in said Security Deed, to wit: All that lot, tract, parcel of land situate, lying and being in the 20th G.M.D. of Bryan County, Georgia and being designated as Parcel "C," containing 134.15 acres more or less. Said parcel is more particularly described by courses and distances upon a plat of survey named "BANKS SUBDIVISION," said survey was prepared and drawn by David A. Brunson, GRLS No. 2538, for J. Lamar Banks, said plat is dated June 11, 1998, and recorded in Plat Slide 464, Folio 1. Said plat and the description thereon, insofar as the same refers to the land herein conveyed is by reference incorporated herein for description and all other legal purposes. Said Parcel "C" is a portion of Tract 1, described in the Quitclaim Deed to J. Lamar Banks from Southeast Timberlands, Inc., said deed being recorded in Deed Book 20, Page 464, in the Office of the Clerk of Superior Court of Bryan County, Georgia. This also being a portion of Tract I, "Old Fancy Hall" (formerly International Paper Co.) Tract. LESS AND EXCEPT THE FOLLOWING: 1.) 5.00 acres as shown on that certain plat of survey made by Denean W. Dixon, R.L.S., dated December 6, 2000, and recorded in Plat Book 497, Page 5, in the Office of the Clerk of Superior Court of Bryan County, Georgia. 2.) 5.75 acres as shown on that certain plat of survey made by Denean W. Dixon, R.L.S. dated September 20, 2000 and recorded in Plat Book 494, Page 1, in the Office of the Clerk of Superior Court of Bryan County, Georgia. 3.) 16.292 acres as shown on that certain plat of survey made by Denean W. Dixon, dated January 7, 2002 and recorded in Plat Book 511, Page 6, in the Office of the Clerk of Superior Court of Bryan County, Georgia. 4.) Lots One (1) through Sixteen (16) as shown on that certain plat of survey made by Denean W. Dixon, dated May 8, 2003 and recorded in Plat Book 526, Page 6, in the Office of the Clerk of Superior Court of Bryan County, Georgia. 5.) Lots Seventeen (17) through Nineteen (19) as shown on that certain plat of survey made by Denean W. Dixon, dated March 09, 2004 and recorded in Plat Book 536, Page 10, in the Office of the Clerk of Superior Court of Bryan County, Georgia. 6.) NO WARRANTY is made with respect to any land that is or may be found to be known as "Wetlands" which are subject to Federal, State and Local Rules and Regulations. SUBJECT to all valid reservation, restrictions, easements and rights of way to record. TOGETHER with all improvements located thereon. Each person attending the sale will be afforded an opportunity to bid on a competitive basis. The Lender has the right to bid at the sale and may be the purchaser of the property. Said Property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, the right of redemption of any taxing authority, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The property will be sold as the property of LLOYD D. MURRAY which to the best of the undersigned's knowledge and belief is the party or parties in possession of the aforementioned property. All proceeds of the sale will be applied to the payment of said indebtedness, the expenses of said sale, including attorney's fees (notice of intent to collect attorney's fees having been given), all as provided in the Security Deed, and the undersigned will execute a Deed Under Power to the purchaser at the sale as provided for in said Security Deed. This sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
