Notice of Sale Notice of Sale Under Power State of Georgia Jackson County By virtue of the power of sale contained in a Deed to Secure Debt by THEODORE RIKEMAN and ANITA RIKEMAN, to FARM EQUITIES, INC., dated February 12, 1997 and filed for record on May 14, 1998 in Deed Book 17-W, Page 287, Jackson County, Georgia records, and securing a Note dated February 12, 1997 in the original principal amount of $15,000.00, there will be sold at a public outcry for cash to the highest bidder before the Courthouse door of Jackson County, Georgia, between the legal hours of sale on the first Tuesday in April 2016, by said holder as Attorney-in-Fact for THEODORE RIKEMAN AND ANITA RIKEMAN, the following property to-wit: All that tract or parcel of land and improvements thereon, lying and being in, the city of Arcade, the county of Jackson, the state of Georgia; Farm #1 in Trotters Ridge Farms Subdivision as shown on Plat Book 46, Page 114, Clerk's Office, Jackson County Superior Court, to which reference is hereby made for a more complete description and containing 1.08 acres. The above described property is also known as 26 Trotters Ridge Road, Jefferson, GA 30549. The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of, among other possible events of default, non-payment of installments on the loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees (notice of intent to collect having been given) and all other payments provided for under the terms of the Security Deed and Note. The property will be sold as the property of the aforesaid grantor subject to the following: all prior restrictive covenants, easements, rights-of-way, security deeds, or encumbrances of record; all valid zoning ordinances; matters which would be disclosed by an accurate survey of the property or by any inspection of the property; all outstanding taxes, assessments, unpaid bills, charges, and expenses that are a lien against the property whether due and payable or not yet due and payable. To the best of the undersigned's knowledge and belief, possession of the subject property is held by Theodore Rikeman and Amy Rikeman, or tenants. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
