Notice of Sale Under Power of Deed to Secure Debt

County of Jackson
Under and by virtue of the Power to Sale contained in that certain Deed to Secure Debt, from GARY D. WHITE and TINY LYNN WHITE to CHARLES BOND and CAROLYN BOND, dated March 3, 2014 and recorded April 9, 2014 in Deed Book 68E, Pages 322-323, Jackson County, Georgia, Public Records, said Deed to Secure Debt having been given to secure a Promissory Note, dated March 3, 2014, in the original principal amount of $19,101.30, there will be sold by the undersigned at public outcry, during the legal hours of sale before the door of the Courthouse of Jackson County, Georgia, on the first Tuesday in April, to-wit: April 5, 2016, to the highest and best bidder for cash, the following described property:
All that tract or parcel of land, with improvements thereon, lying and being in the City of Nicholson, 253rd G.M.D., Jackson County, Georgia, being shown as Lot 4 of “Hawks Landing of Jacksonâ€, according to a plat dated September 10, 1992, and recorded in Plat Book 35, Page 226, in the records of the Clerk of Superior Court for Jackson County, Georgia, said plat being incorporated herein by reference for a more particular description.
Together with all improvements located thereon, including that certain 1994 Fleetwood Oak Knoll double-wide manufactured home bearing manufacturer's serial number GEO782740 and GEO782741, which is located on and affixed to the above referenced property.
THIS CONVEYANCE is made subject to all zoning ordinances, easements, rights-of-way for public roads and public utilities and any restrictions of record affecting said described property.

Said property is located at 84 Hawks Court, Nicholson GA 30565, Jackson County, Georgia.
The debt secured by said Deed to Secure Debt and Note have been and is hereby declared due and payable in full because of default pursuant to the terms of said Deed to Secure Debt and Note. Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with requirements of Official Code of Georgia Annotated Section 44-14-162.2 and the terms of Deed to Secure Debt and Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt including attorney=s fees, and the remainder, if any shall be applied as provided by law.
To the best of the undersigned's knowledge an belief the property is in the possession of GARY D. WHITE and TINY LYNN WHITE, and said property will be sold as the property of GARY D. WHITE and TINY LYNN WHITE, subject to outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The undersigned will execute a deed to the purchaser at said sale as provided in Deed to Secure Debt.
