UNDER POWER
STATE OF GEORGIA
COUNTY OF SCHLEY
By virtue of a Power of Sale contained in that certain Deed to Secure Debt from Clint R. Couey and Shannon L. Couey to Conseco Finance Servicing Corp. f/k/a Green Tree Servicing LLC n/k/a Ditech Financial LLC, dated September 25, 2000 and recorded in Deed Book 80, Page 238, in the Office of the Clerk of Superior Court of Schley County, Georgia, said Deed to Secure Debt having been given to secure a Note dated, September 25, 2000, in the original principal amount of Sixty Four Thousand Three Hundred Thirty and 38/100 Dollars ($64,330.38) with interest thereon as provided therein, having been last sold, assigned and transferred to U.S. Bank N.A., as Trustee for Manufactured Housing Contract Senior/Subordinate Pass-Through Certificate Trust 2000-6, recorded in Deed Book 233, Page 46, aforesaid records, will be sold at public outcry to the highest bidder for cash before the courthouse door of Schley County, Georgia, within the legal hours of sale on the first Tuesday of April 2016, regarding the following described property:
All that tract or parcel of land lying and being in Land Lot 8 of the 30th Land District of Schley County, Georgia, being more particularly described as follows: Start at the southwest corner of the intersection of John Rayborn Road and Concord Church Road and proceed along the western right-of-way of Concord Church Road, south 01 degrees 02 minutes 35 seconds west a distance of 483.51 feet to the point of beginning. From said point of beginning proceed south 01 degree 02 minutes 35 seconds west a distance of 200.00 feet to a point; thence turn north 87 degrees 47 minutes 32 seconds west a distance of 1089.23 feet to a point; thence turn north 01 degree 02 minutes 35 seconds east a distance of 200.00 feet to a point; thence turn south 87 degrees 47 minutes 32 seconds east a distance of 1089.23 feet to the point of beginning. This being the same property described in that Plat of Survey dated September 15, 2000, prepared by Malcolm Burnsed, Registered Surveyor No. 1691, as the "Property of Clint Couey & Shannon Couey", recorded in Plat Book 7, Page 210 of the Deed Records in the Office of the Clerk of Superior Court of Schley County, Georgia, said plat being incorporated herein by reference thereto.
Said property is commonly known as 2840 Concord Church Rd., Ellaville, GA 31806.
The indebtedness secured by said Deed to Secure Debt has been and is hereby declared due because of default under the terms of said Deed to Secure Debt and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys fees and all other payments provided for under the terms of the Deed to Secure Debt and Note.
Said property will be sold subject to the following items which may affect the title of said property; zoning ordinances, matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Deed to Secure Debt. To the best of the knowledge and belief of the undersigned, the party in possession of the property is Clint R. Couey and Shannon L. Couey or tenant(s).
