NOTICE OF SALE UNDER POWER, GLYNN COUNTY Pursuant to the Power of Sale contained in a Security Deed given by Cindie Nelson to E*trade Mortgage Corporation dated 8/15/2007 and recorded in Deed Book 2325 Page 257 Glynn County, Georgia records; as last transferred to or acquired by E*TRADE BANK, conveying the after-described property to secure a Note in the original principal amount of $ 150,000.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Glynn County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on April 05, 2016 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: ALL of that certain condominium unit constituting real property situate, lying and being on St. Simons Island in Glynn County, Georgia, and being ALL OF UNIT NUMBER 48 OF VILLAGE GREEN CONDOMINIUMS, as shown upon that certain print or plat or survey of Village Green Condominiums prepared by James L. Conine, G.R.S. No. 1545, recorded in the Office of the Clerk of the Glynn Superior Court in Plat Drawer 19 as Plat No 859 and to the plans and specifications of village Green Condominium Plan Book 4, Page 573, in the aforesaid records. The Unit contains an undivided percentage interest in and to the common elements of Village Green Condominiums (as such common area is defined in said Declaration), together with all of the right, title, and interest of the Grantor in and to said Unit and the appurtenances thereunto under said Declaration. The above described plat, plans and declarations and any recorded amendments thereto are incorporated herein, by reference, and made a part hereof in which plat, plans, and declaration reference for all other purposes, which said Declaration is of record in Deed Book 24-K, beginning at Page 867, of said records. The conveyance is made subject to the terms, provisions and restrictions contained in the Georgia Condominium Act, Georgia Laws, 1975 beginning at Page 609, as amended from time to time and in said Declaration. By acceptance of this deed Grantee acknowledges receipt of a copy of said declaration and Covenants and agrees to comply with at the terms, provisions and restrictions set forth therein as amended from time to time. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed.
