NOTICE OF SALE
UNDER POWER
By virtue of the power of sale contained in that certain Security Deed (hereinafter the Security Deed) from Eddie D. Russell to The Community Bank (with RES-GA FOURTEEN, LLC as assignee of Multibank 2009-1 RES-ADC Venture, LLC (Multibank), as assignee of Federal Deposit Insurance Corporation (FDIC), as receiver for The Community Bank (TCB)), dated December 17, 2007, recorded at Deed Book 48521, Page 62, Gwinnett County, Georgia records; said Security Deed being given to secure indebtedness under that certain Promissory Note (as renewed, hereinafter the Note) from Eddie D. Russell to TCB (with RES-GA FOURTEEN, LLC as assignee of Multibank, as assignee of FDIC, as receiver for TCB), dated December 17, 2007, and renewed on May 29, 2008, in the renewed principal amount of ONE HUNDRED EIGHTY THREE THOUSAND SEVEN HUNDRED FIFTY AND NO/100 DOLLARS ($183,750.00), with interest on the unpaid balance from the date thereof until maturity or until paid, together with all other amounts payable with respect thereto; there will be sold by the undersigned at public outcry to the highest bidder, for cash before the Courthouse door in Lawrenceville, Gwinnett County, Georgia, within the legal hours of sale on the first Tuesday in April, 2016, the property being more fully described as follows:
ALL THAT TRACT or parcel of land lying and being in Land Lot 74 of the 5th District of Gwinnett County, Georgia, and being more particularly described on plat recorded at Plat Book 34, Page 239-A, Gwinnett County records which plat is hereby referred to and made a part of this description. Said property located at 1379 SCENIC HIGHWAY, SNELLVILLE, GEORGIA, according to the present system of numbering in Gwinnett County, Georgia.
LESS AND EXCEPT any property taken by that certain Condemnation Action styled Department of Transportation, Condemnor, vs. 0.111 acres of land; and certain easement rights; and Eddie D. Russell, et al, Condemnees, Civil Action File No. 06A-03166-8, Superior Court of Gwinnett County, Georgia.
The debt secured by said Note and Security Deed has been and is hereby declared due and payable in full because of, among other possible events of default, non payment of principal and interest owed in accordance with the terms of the Note and the Security Deed. The indebtedness remaining in default, this sale will be made for purposes of paying the same and all expenses of this sale, including attorneys fees.
To the best knowledge and belief of the undersigned, the subject property is in the possession of Eddie D. Russell or parties claiming by, through or under Eddie D. Russell.
Said property will be sold as the property of Eddie D. Russell on an as is, where is basis, without recourse and without representation or warranty, express or implied, of any nature whatsoever with respect thereto and will be sold subject to all unpaid taxes, assessments, and any superior items of record, as well as any matters as would be revealed by an accurate survey and inspection of the subject property.
