STATE OF GEORGIA COUNTY OF GWINNETT NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain Deed to Secure Debt with Power of Sale (as modified, hereinafter the Security Deed) from Greenleaf Business Development Co., LLC to Omni National Bank (with CML-GA TWO, LLC as assignee of Multibank 2009-1 CML-ADC Venture, LLC (Multibank), as assignee of Federal Deposit Insurance Corporation (FDIC), as receiver for Omni National Bank (ONB)), dated May 11, 2007, recorded at Deed Book 47948, Page 684, Gwinnett County, Georgia records, as modified by that certain First Modification of Promissory Note and Deed to Secure Debt dated June 30, 2008 and recorded in Deed Book 48991, Page 341, aforesaid records, and further modified by that certain unrecorded Second Modification of Promissory Note and Deed to Secure Debt dated December 30, 2008; said Security Deed being given to secure indebtedness under that certain Promissory Note (as modified, hereinafter the Note) from Greenleaf Business Development Co., LLC to ONB (with CML-GA TWO, LLC as assignee of Multibank, as assignee of FDIC, as receiver for ONB), dated May 11, 2007 and modified on June 30, 2008 and December 30, 2008, in the last modified principal amount of TWO HUNDRED TWO THOUSAND THREE HUNDRED THIRTY NINE AND 12/100 DOLLARS ($202,339.12), with interest on the unpaid balance from the date thereof until maturity or until paid, together with all other amounts payable with respect thereto; there will be sold by the undersigned at public outcry to the highest bidder, for cash before the Courthouse door in Lawrenceville, Gwinnett County, Georgia, within the legal hours of sale on the first Tuesday in April, 2016, the property being more fully described as follows: Beginning on the northerly and westerly rights-of-ways of Buford Highway and South Old Peachtree Road; thence south along the right-of-way of Buford Highway 235 to right-of-way marker and True Point of Beginning; thence from said TPOB S 43 57 31 E 14.03 to right-of-way marker also on right-of-way of Buford Highway; thence along right-of-way S 46 59 07 W 99.74; thence leaving right-of-way N 43 33 54 W 378.66 to an iron pin found on easterly right-of-way of Freedom Lane; thence along right-of-way N 39 18 00 E 97.80 to IPF; thence away from right-of-way S 43 57 31 E 391.77 to TPOB. Said parcel being in Land Lot 259 of the 6th District of Gwinnett County, and containing 0.8703 acres, and surveyed by Ronald E. Gudger, LS of Gudger Surveying, Inc. for Greenleaf Business Development Co, LLC on May 1, 2007. As shown on that certain survey prepared by Ronald E. Gudger, GRLS No. 2089 of Gudger Surveying, Inc., dated May 1, 2007 for Greenleaf Business Development Co, LLC, Omni National Bank and LandAmerica/Lawyers Title Insurance Corporation. The debt secured by said Note and Security Deed has been and is hereby declared due and payable in full because of, among other possible events of default, non payment of principal and interest owed in accordance with the terms of the Note and the Security Deed. The indebtedness remaining in default, this sale will be made for purposes of paying the same and all expenses of this sale, including attorneys fees. To the best knowledge and belief of the undersigned, the subject property is in the possession of Greenleaf Business Development Co., LLC or parties claiming by, through or under Greenleaf Business Development Co., LLC.
