NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY By virtue of the Power of Sale contained in that certain Security Deed given from Joanne B. Mullan to Regions Bank, dated 05/27/2005, recorded 07/05/2005in Deed Book 999, Page 933, Richmond County, Georgia records, said Security Deed having been given to secure a Note of even date in the principal amount of TWENTY-FOUR THOUSAND AND 00/100DOLLARS ($24,000.00),with interest thereon as provided for therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Richmond County, Georgia, within the legal hours of sale on the first Tuesday in April 2016 by Regions Bank, as Attorney in Fact for Joanne B. Mullan, all property described in said Security Deed including but not limited to the following described property: ALL THAT LOT OR PARCEL OF LAND, TOGETHER WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING KNOWN AND DESIGNATED AS UNIT 1, BUILDING F OF SUNNYVALE SUBDIVISION AS SHOWN UPON A PLAT PREPARED BY GEORGIA-CAROLINA SURVEYING AND ENGINEERING COMPANY, DATED MARCH 27, 1993, WHICH IS FILED FOR RECORD IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT FOR RICHMOND COUNTY, GEORGIA, ON REALTY REEL 416, AT PAGES 2297-2302. REFERENCE IS HEREBY MADE TO SAID PLAT FOR A MORE COMPLETE AND ACCURATE DESCRIPTION AS TO THE METES, BOUNDS AND LOCATION OF SAID PROPERTY. THIS PROPERTY IS CONVEYED SUBJECT TO A DECLARATION OF COVENANTS, CONDITIONS, EASEMENTS AND RESTRICTIONS APPLICABLE TO SUNNYVALE WHICH IS RECORDED IN THE AFORESAID CLERK`S OFFICE ON REALTY REEL 416, PAGES 2303-2310 AND A DECLARATION OF COVENANTS AND RESTRICTIONS PROVIDING FOR SUNNYVALE ASSOCIATION, INC., RECORDED ON REALTY REEL 416, PAGES 2311-2323. BEING THE SAME PROPERTY CONVEYED TO JO ANN MULLAN BY DEED FROM JAY L. BECKER AND MAXINE C. BECKER RECORDED 04/27/2004 IN DEED BOOK 924, PAGE 757-758, IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF RICHMOND COUNTY, GEORGIA. TAX ID# 016-2-228-00-0. Said property being known as 77 SUNNYVALE LANE, AUGUSTA, GEORGIA 30907 according to the present numbering system in Richmond County. The indebtedness secured by said Security Deed has been declared due because of default under the terms of said Security Deed and Note. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to the following items which may affect the title to said property: any superior Security Deeds of record; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed.
