Legal 71 Notice  Of  Sale  Under  Power State Of Georgia, County Of Pike. Notice is hereby given that pursuant to the power of sale contained in a Deed to Secure Debt executed and delivered on August 8, 1992, by Mark Vaughn, as Grantor, to Lex Horner, as Grantee, and recorded in Deed Book 152, Page 195, Pike County Superior Court records, and by virtue of default in payment in indebtedness therein mentioned, which has made the aforesaid power of sale operative and effective, the undersigned, Patricia Horner, successor by inheritance to Lex Horner, as Attorney‑in‑fact for Mark Vaughn will sell at public outcry before the Courthouse door in Pike County, Georgia, on Tuesday, April 5, 2016, during the legal hours of sale, to the highest bidder for cash, the property described in said Security Deed to‑wit: All that tract or parcel of land lying and being in the Village of Meansville, Pike County, Georgia, known as the W. H. Means store and lot and more particularly described as follows: Commencing at a point in the center of public road 65 feet west of right of way of Southern Railroad where Mrs. M. J. green and Mrs. E. E. Harps line strike the center of the public road; thence West along the center of said road 89 feet; thence South parallel with the West of the depot lot 227 feet; thence East 85 ½ feet to the line of the West side of Mrs. Harp's and Mrs. Green's depot line; thence North along said line 217 feet to beginning point. Notice of the initiation of proceedings to exercise the power of sale in the Deed to Secure Debt hereinabove referenced has been given and of Grantee's intention to collect attorney's fees in connection herewith as required by law. The note executed on August 8, 1992, by Mark Vaughn, as Grantor, to Lex Horner, as Grantee, and secured by said Deed to Secure Debt and assignments, is now in default and the said Patricia Horner, successor by inheritance to Lex Horner, does so elect that said indebtedness, with principal and interest, become due and payable at once. The said property shall be sold subject to all outstand-ing taxes and assessments against said property. The proceeds from said sale shall be distributed as follows: (1) to pay the expense of said sale; (2) to pay all indebtedness secured by said Deed to Secure Debt; (3) to pay attorney's fees; and (4) to distribute any excess proceeds as provided by law.
