GEORGIA, RABUN COUNTY
NOTICE OF SALE UNDER POWER
Under and by virtue of the power of sale contained in that Deed to Secure Debt from Knox Gragg to CBT, a Division of SCBT, N.A. dated June 3, 2011, recorded June 9, 2011, in Deed Book I37, Pages 108-118, Rabun County, Georgia Deed Records, and the power of sale contained in that Deed to Secure Debt from Knox Gragg to CBT, a Division of SCBT, N.A. dated June 3, 2011, recorded June 9, 2011, in Deed Book I37, Pages 126-136, Rabun County, Georgia Deed Records, as modified of record on August 26, 2014 by a Modification of Deed to Secure Debt recorded October 28, 2014, in Deed Book J41, Pages 77-80, Rabun County, Georgia Deed Records, each Deed to Secure Debt being presently held by South State Bank f/k/a CBT, a Division of SCBT, N.A., the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door in said County, during the legal hours of sale, on the first Tuesday in March, 2016 by South State Bank f/k/a CBT, a Division of SCBT, N.A. as Attorney-in-Fact for Knox Gragg the following described property:
TRACT 1:
ALL THAT TRACT OR PARCEL of land lying and being in Land Lots 70 & 79 of the 5th Land District of Rabun County, Georgia and being 3.28 acres, more or less, as shown on plat of survey prepared by Hubert Lovell, R.L.S., dated March 1, 1996 and recorded among Rabun County, Georgia Records in Plat Book 37, Page 205, said plat being incorporated herein by reference for a more full and complete description.
AS SHOWN on said plat, a portion of the above described tract or parcel of land is an existing road. The above described tract or parcel of land is hereby conveyed subordinate to those portions of the same lying within the right-of-way or bounds of said road. Also conveyed is a perpetual non-exclusive or road right-of-way easement over and across that certain road easement depicted on said plat, for the express purpose of providing ingress to and egress from said described tract or parcel of land with the public road system of Rabun County, Georgia.
TRACT 2:
ALL THAT TRACT OR PARCEL of land lying and being in Land Lots 70 & 79 of the 5th Land District of Rabun County, Georgia and being 1.55 acres, more or less, as shown on plat of survey prepared by Richard H. Holcomb, R.L.S., dated November 15, 1997 and recorded among Rabun County, Georgia Records in Plat Book 38, Page 267, said plat being incorporated herein by reference for a more full and complete description.
ALSO CONVEYED is a perpetual non-exclusive road right-of-way easement over and across that certain road easement shown on above referenced plat for the express purpose of providing ingress to and egress from said described tract or parcel of land with the public road system of Rabun County, Georgia.
TRACT 3:
ALL THAT TRACT OR PARCEL of land lying and being in Land Lot 79 of the 5th Land District of Rabun County, Georgia and being Lot 1, containing 1.34 acres, more or less, Lot 2, containing 1.33 acres, more or less, and Lot 3, containing 1.33 acres, more or less, as shown on plat of survey prepared by William F. Rolader, R.L.S., dated February 12, 2008 and recorded among Rabun County, Georgia Records in Plat Book 59, Page 162, said plat being incorporated herein by reference for a more full and complete description.
TRACT 4:
ALL THAT TRACT OR PARCEL of land lying and being in Land Lots 70 & 79 of the 5th Land District of Rabun County, Georgia and being 0.814 acres, more or less, as shown on plat of survey prepared by Richard H. Holcomb, R.L.S., dated May 29, 1999 and revised on June 8, 1999 and recorded among Rabun County, Georgia Records in Plat Book 42, Page 283, said plat being incorporated herein by reference for a more full and complete description.
The indebtedness secured by the referenced Deeds to Secure Debt being in default for non-payment, among other possible events of default, this sale will be made for the purposes of paying the indebtedness and all expenses of sale, including attorney's fees (notice having been given as provided by law).
The property will be sold subject to the following:
(1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the Deeds to Secure Debt first set out above.
To the best of the undersigned's knowledge and belief, the party in possession is the Estate of Knox Gragg or a tenant or tenants.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deeds to Secure Debt.
