Notice of Sale Notice of Sale Under Power Georgia, Jackson County By virtue of power of sale contained in Security Deed from Stephen A. O'Connor and Jade O'Connor to North Georgia Bank, dated January 15, 2010, recorded in Deed Book 56Y, page 465, being assigned by a Transfer and Assignment to BankSouth, dated April 14, 2011, recorded in Deed Book 60R, page 160, as modified by a Modification of Deed to Secure Debt, dated June 14, 2011, recorded in Deed Book 60R, page 162, being further modified by a Modification of Deed to Secure Debt, dated April 26, 2013, recorded in Deed Book 65O, page 537, and further modified by a Modification of Deed to Secure Debt, dated January 27, 2015, recorded in Deed Book 70E, page 513, all in the Office of the Clerk of Superior Court of Jackson County, Georgia (hereinafter collectively referred to as the “Security Deed”), there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door in Jackson County Georgia, within the legal hours of sale on the first Tuesday in March, 2016, the following described property: ALL that tract or parcel of land, situate, lying and being in the l747th G.M.D., Jackson County, Georgia, being known and designated as Lot 26 of Saddle Shoals Subdivision, as shown on a plat entitled “Final Plat - Saddle Shoals Subdivision”, dated October 8, 2005 by Schmitt Engineering and Land Surveying, Inc., Registered Land Surveyors, said plat being recorded in Plat Book 66, pages 158-159, in the Office of the Clerk of the Superior Court of Jackson County, Georgia, and being incorporated herein by reference for a more particular description. THIS property is subject to Protective Covenants as recorded in Deed Book 41-C, page 431 and Deed Book 34-M, page 250, Conservation and Recreation Easement Agreement to Saddle Shoals Homeowners Association, dated October 20, 2005, being recorded in Deed Book 41-C, page 422, Utility Easement in favor of Jackson County, Georgia, dated October 20, 2005, being recorded in Deed Book 41-C, page 424, rights of riparian owners in and to the flow of the waters of the creek located on the property, one hundred foot stream buffer and fifty foot easement for recreation trail as shown at Plat Book 66, page 158, all Jackson County, Georgia Records. The residence situated upon the above described property is known and designated as 161 Bassingborne Drive, Athens, GA 30607, according to the present system of numbering houses in Jackson County, Georgia. Together with all buildings, structures, and other improvements now or hereafter located on said property, or any part and parcel thereof. BankSouth, is the current holder and owner of the Security Deed and the promissory note secured thereby. The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default the debt has matured by its terms and not been paid. Said default not being cured, and the debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of the sale, including accrued attorney's fees. Said property will be sold by BankSouth, as attorney in fact for Stephen A. O'Connor and Jade O'Connor, subject to any outstanding ad valorem taxes and/or assessments, and matters of record, if any, having priority over the Security Deed. To the best of the knowledge and belief of BankSouth, the people in possession of above described property are Stephen A. O'Connor and Jade O'Connor or persons claiming under them.
