gpn11 NOTICE OF SALE GEORGIA, COLQUITT COUNTY WHEREAS, on December 10, 2010, IVON ARMANDO FOLSOM delivered to DEBORAH J. BLACKMAN, a certain security deed containing power of sale in order to secure the indebtedness therein recited, as shown by the record of same in DEED BOOK 1063, PAGE 044, recorded December 14, 2010, among the Public Records of Colquitt County, Georgia, conveying the following described property, to-wit: All that tract or parcel of land situate, lying and being in the 8th Land District of Colquitt County, Georgia, of Land Lot 340 and being designated as Lot 16 of Deer Run Subdivision, as shown on that certain plat of survey thereof by Charles H. Kilgore, Surveyor, dated June 6, 1988, and recorded in Plat Book 21, Page 44, Colquitt County Records, which plat of survey and the record thereof are incorporated herein by reference for all legal and necessary purposes. SUBJECT TO the Declaration of Restrictions and Protective Covenants for Deer Run Subdivision which have been recorded in Deed Book 417, Page 439, et. al., Colquitt County Records. Also conveyed is that certain 1988 Vagabond Mobile Home, Serial Number GDWVG198843219AB. WHEREAS, default has been made in the payment of the indebtedness secured by the above described security deed and the holder has elected to declare the entire amount of the indebtedness due according to the terms of the security deed and the promissory note secured thereby. The undersigned gave IVAN ARMANDO FOLSOM, notice of default and the right to cure notice as provided in the security deed, and the default was not cured as required, and the undersigned has elected to proceed with non-judicial foreclosure as provided for in the security deed. NOW THEREFORE, the undersigned will proceed to sell the property as the property of IVAN ARMANDO FOLSOM, at public outcry to the highest bidder for cash before the courthouse door in COLQUITT county within the legal hours of sale on the FIRST TUESDAY IN MARCH, for the purpose of satisfying the indebtedness and the expenses of sale, including attorneys fees, notice of which has been given as provided by law, and will execute a deed to the purchaser at sale in a reasonable amount of time and apply the proceeds thereof as provided in said security deed. Said property will be sold subject to all unpaid taxes, liens, and other assessments and restrictions of record, if any. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. The undersigned reserves the right to reject any and all bids, to continue the sale from day to day and to withdraw said property from sale and subsequently to reoffer same in the event no reasonable bid is received and accepted.
