Sale Under Power Contained In Deed To Secure DebtÂ
Georgia, Pike County:
By virtue of the power and authority contained in a Deed To Secure Debt and under the power of sale contained therein, executed by Stanley A. Allen and Deborah D. Allen to United Bank, dated November 4, 2003, and of record in Deed Book 492, Page 41, in the Office of the Clerk of the Superior Court of Pike County, Georgia, the undersigned will sell at public outcry to the highest bidder for cash before the courthouse doors in the City of Zebulon, Pike County, Georgia, between the legal hours of sale on the first Tuesday in March, 2016, the following described real estate, to-wit:
All that tract or parcel of land, containing 4.3297 acres, more or less, lying and being in Land Lot 195 and 196 of the 1st Land District of Pike County, Georgia, and being more particularly described as Lot 7A of Block C, Unit I, Ranchland Estates and said Lot 7A being more particularly described as follows: Beginning at an iron pin which marks the northwest corner of Lot 7, Block C and which said iron pin is located on the southerly margin of Trails End, (60' right of way) and which said iron pin marks the point of beginning; from said point of beginning run thence north 89 degrees 57 minutes 5 seconds east a distance of 272.65 feet to a point; run thence south 10 degrees 35 minutes 50 seconds west a distance of 525.19 feet to a point; run thence north 85 degrees 58 minutes 58 seconds west a distance of 470.71 feet to a point; run thence north 31 degrees 16 minutes 58 seconds east a distance of 565.20 feet to an iron pin located on the south margin of Trails End and the point of beginning.
The indebtedness secured by said Deed To Secure Debt having become in default, said real estate will be sold as the property of Stanley A. Allen and Deborah D. Allen, and will be sold subject to a superior outstanding indebtedness secured by a Security Deed from Stanley A. Allen and Deborah D. Allen to United Bank, dated July 19, 2005, of record in Deed Book 593, Page 141, said Clerk's Office, as modified by Loan Modification Agreement dated July 1, 2015, of record in Deed Book 1003, Page 246, said Clerk's Office. Said sale shall further be subject to any and all unpaid taxes and assessments, and other restrictions and easements of record, if any, and the proceeds of such sale will be applied to the payment of the principal and interest of said indebtedness, and the cost of this proceeding, including attorneys' fees, and the balance, if any, shall be paid over to the party or parties entitled thereto.Â
