NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY Under and by virtue of the power of sale contained in a Deed to Secure Debt from James D. Spires & Jamie D. Spires, a/k/a Jamie Farr, to Askin Enterprises, Ltd. Co., dated July 20, 2001, recorded in Deed Book 748, Pages 2287-2290, Richmond County, Georgia records, as last transferred to Otis F. Askin in a Blanket Assignment recorded in Book 804, Pages 104-105, said Deed to Secure Debt having been given to secure a note dated July 20, 2001, in the original principal sum of Thirty Thousand Five Hundred and 00/100 ($30,500.00) Dollars with interest from date at the rate stated in said note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Richmond County, Georgia within the legal hours of sale on the first Tuesday in March, 2016, the property described in said Deed to Secure Debt, to wit: All that parcel of land, with all improvements thereon, situate, lying, and being in the 129th G.M.D., Richmond County, Georgia, containing 4.016 acres, more or less, located South of Augusta, as shown on a plat thereof prepared by Ayer, Barker, Graham & Associates, Reg. Land Surveyor, which plat is of record in the Office of the Superior Court Clerk for Richmond County, Georgia in Plat Reel 125, Page 993; reference being made to said plat for a more complete and accurate description of said property. Said property is sold subject to easements retained by Askin Enterprises, Ltd. Co. as described in a Warranty Deed recorded in Reel 748, Pages 2285-2286. Also included in this conveyance is a single-wide mobile home located thereon, sold in AS IS WHERE IS CONDITION. Said property is commonly known as 5005 Westbrook Drive, Augusta, Georgia 30906. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, the non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including legal fees. This sale will be held subject to all unpaid taxes, assessments, and restrictions of record, if any, transfer tax and all state and county taxes. James D. Spires being deceased, said property will be sold as the property of the Estate of James D. Spires & Jamie D. Spires, a/k/a Jamie Farr, the property to the best information, knowledge, and belief of the undersigned, being presently in the possession of the Estate of James D. Spires & Jamie D. Spires, a/k/a Jamie Farr, and the proceeds of said sale will be applied to the payment of said indebtedness and all the expenses of said sale, including attorney's fees, all as provided in said deed, and the balance, if any, will be distributed as provided by law.
