CLASS:007 NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF COWETA Under and by virtue of the power of sale contained with that certain Security Deed dated February 4, 2008, from Mary T. Griffies and Brian P. Griffies to Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Bank, FSB, recorded on February 21, 2008 in Deed Book 3312 at Page 261, as modified by Loan Modification Agreement recorded in Deed Book 4012, at page 52, Coweta County, Georgia Records, having been last sold, assigned, transferred and conveyed to U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust by Assignment and said Security Deed having been given to secure a note dated February 4, 2008, in the amount of $138,500.00, having a modified loan amount of $129,233.09, said note and modification thereof being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Coweta County, Georgia, on March 1, 2016, the following described real property (hereinafter referred to as the "Property"): ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN THE CITY OF NEWMAN, IN COWETA COUNTY, GEORGIA, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGIN AT AN IRON STAKE ON THE SOUTH SIDE OF EAST BROAD STREET AT THE EAST LINE OF PROPERTY NOW OR FORMERLY BELONGING TO R.D. COLE AND RUN THENCE SOUTH ALONG SAID COLE LINE ONE DEGREE THIRTY MINUTES EAST ONE HUNDRED NINETY-ONE (191) FEET TO STAKE; THENCE EAST SEVENTY SEVEN (77) FEET TO STAKE; THENCE NORTH ONE DEGREE THIRTY MINUTES WEST ONE HUNDRED NINETY (190) FEET TO EAST BROAD STREET; THENCE WEST ALONG THE SOUTH SIDE OF EAST BROAD STREET SEVENTY SEVEN (77) FEET TO POINT OF BEGINNING, ACCORDING TO PLAT OF SAME MADE BY T.Y. MATTOX, COUNTY SURVEYOR, DATED NOVEMBER 16, 1938, AND THE NORTHEAST CORNER OF TRACT HEREIN CONVEYED BEING ONE HUNDRED SIXTY THREE (163) FEET WEST OF THE INTERSECTION OF PINSON STREET AND EAST BROAD STREET IN SAID CITY OF NEWMAN, AND BEING A PART OF AND OFF THE WEST SIDE OF THAT CERTAIN TRACT OF LAND DEEDED W.H. REYNOLDS BY E.M. COLE, AND WHICH SAID TRACT SO DEEDED IS FULLY DESCRIBED IN DEED FROM E.M. COLE TO W.H. REYNOLDS OF RECORDS IN DEED BOOK 21, PAGE 121, CLERK'S OFFICE, COWETA SUPERIOR COURT, REFERENCE TO WHICH IS HAD. THIS CONVEYANCE IS MADE SUBJECT TO ALL ZONING ORDINANCES, EASEMENTS AND RESTRICTIONS OF RECORD AFFECTING SAID BARGAINED PREMISES. FOR TITLE DEED REFERENCE IN BOOK 3031, PAGE 364. The debt secured by the Security Deed and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys' fees. Notice of intention to collect attorneys' fees has been given as provided by law. To the best of the undersigned's knowledge, the person(s) in possession of the property is/are Mary T. Griffies and Brian P. Griffies. The property, being commonly known as 115 E Broad Street, Newnan, GA, 30263 in Coweta County, will be sold as the property of Mary T. Griffies and Brian P. Griffies, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
