NOTICE OF SALE UNDER POWER
STATE OF GEORGIA COUNTY OF FANNIN
By virtue of a Power of Sale contained in that certain Security Deed from Donald Lynn Stiles and Jennifer Jean Stiles to Copper Basin Federal Credit Union, dated November 9, 2010, filed November 10, 2010, recorded in Deed book 947, Page 93-107, Fannin County, Georgia records, as may have been modified and/or renewed from time to time, (hereinafter the Security Deed), the Security Deed being given to secure a Note of even date between Donald Lynn Stiles and Jennifer Jean Stiles (borrower) and Copper Basin Federal Credit Union (lender), in the original principal amount of One Hundred Eleven Thousand Seven Hundred Eighty-Two and 00/100 Dollars ($111,782.00), as may have been modified/renewed from time to time, (hereinafter Note), with interest thereon as provided therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Fannin County, Georgia, within the legal hours of sale on the first Tuesday in February, 2016, the following described property:
All that tract or parcel of land lying and being in the 8th District and 2nd Section of Fannin County, Georgia and being a part of Land Lot No. 33, located in the Kingtown Addition to the City of McCaysville and more particularly described as follows:
BEGINNING at the Southeast corner of the property conveyed at a utility pole on the North side of Kingtown Street (sometimes referred to as Raway Street) and running thence a Northerly direction back from said street a distance of 115.0 feet, more or less, to a stake at fence; thence Westerly with said fence a distance of 291.0 feet, more or less, to a point where fence crosses ditch; thence Southerly with said ditch a distance of 81.0 feet, more or less, to Kingtown Branch; thence Easterly with said Kingtown Branch a distance of 171.0 feet, more or less, to a ditch; thence Southerly with said gully to point of Raway Street; thence Easterly with said Raway Street a distance of 250.0 feet, more or less, to the point of BEGINNING, containing by estimation two (2) acres, more or less.
Subject to all easements, restrictions, and rights of way as appearing of record.
Subject to existing easements and right of ways for public roads, if any. This conveyance made together with right of ingress, egress and utility service along existing roads to the subject property.
Subject to Fannin County, Georgia and City of McCaysville Subdivision regulations, Mobile Home regulations and any zoning or other ordinances, if any.
Said property is commonly known as 164 Rahway (Raway) Street, McCaysville, Georgia 30555.
To have and to hold the said bargained premises together with all improvements now situated or hereafter placed thereon, and all interest, right and equity which the party of the first part now or may hereafter have therein to the only proper use, benefit, and behoof of the said party of the second part, its successors, heirs and assigns forever, in fee simple.
The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purposes of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien on the property but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed.
The individual at Copper Basin Federal Credit Union who has full authority to negotiate, amend, and/or modify the terms of this Security Deed is Rhonda Jacobs, 771 Ocoee Street, Copperhill, TN 37317 (706)632-4888. . To the best knowledge and belief of the undersigned, the party in possession of the property is Donald Lynn Stiles, Jennifer Jean Stiles, or a tenant or tenants.
