NOTICE OF FORECLOSURE SALE UNDER POWER RICHMOND COUNTY, GEORGIA THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Shelia R. Cummings and Kenneth E. Cummings, Sr. to First Choice Mortgage, Inc., dated October 24, 2003, and recorded in Deed Book 00894, Page 1400, Richmond County, Georgia Records, as last transferred to U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust by assignment recorded on October 1, 2015 in Book 1503 Page 930 in the Office of the Clerk of Superior Court of Richmond County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Seventy-Eight Thousand Six Hundred Sixty-Two and 0/100 dollars ($78,662.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Richmond County, Georgia, within the legal hours of sale on February 2, 2016, the following described property: All that lot or parcel of land with the improvements thereon, situate, lying and being in the former City of Augusta, County of Richmond and State of Georgia, on the North side of Barnes Street, between Campbell and Cumming Streets, having a front on Barnes Street of forty-one (41) feet, more or less, and extending back of equal width halfway to Calhoun Street a distance of one hundred twenty five (125) feet, more or less, being designated on a plat of lots recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Deed Book 2D, page 328, as Number (6) and bounded, now or formerly on the North by Lot Five (5) said Property of Margaret Hooper, South by said Barnes Street and West by Lot Eight (8) said plat the Property of Mrs. M.E. Magarahan. This being the same property conveyed to Basic Holdings, L.L.C. from Darryl Rowe by Warranty Deed dated March 21, 2001, and recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia in Realty Reel 721, page 1189. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
