NOTICE OF SALE UNDER POWER
STATE OF GEORGIA
COUNTY OF GILMER
By virtue of a Power of Sale contained in that certain Security Deed from Scottie Edward Sanford to Copper Basin Federal Credit Union, dated June 17, 2011, filed June 20, 2011, recorded in Deed Book 1677, Page 107-120, Gilmer County, Georgia records, as may have been modified and/or renewed from time to time (hereinafter the “Security Deedâ€), the Security Deed being given to secure a Note of even date between Scottie Edward Sanford (borrower) and Copper Basin Federal Credit Union (lender), in the original principal amount of Seventy Thousand and 00/100 Dollars ($70,000.00) , as may have been modified/renewed from time to time (hereinafter “Noteâ€), with interest thereon as provided therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Gilmer County, Georgia, within the legal hours of sale on the first Tuesday in February, 2016, the following described property:
All that tract or parcel of land lying and being in Land Lot No. 45 of the 11th District and 2nd Section of Gilmer County, Georgia, containing 0.63 acre and being designated as LOT 3, WESTWOODS SUBDIVISION, as shown on plat of survey for Westwoods Subdivision dated February 1985, prepared by Greer Dover, County Surveyor of Gilmer County, Georgia and being recorded in Plat Book 12, page 232, Gilmer County Deed Records. Said plat is incorporated herein by reference for a more complete and accurate legal description of the above described property; together with all improvements, fixtures, shrubbery, including a single-family residence and appurtenances thereto.
The above described property is subject to the Covenants, Conditions and Restrictions recorded in Deed Book 151, page 682, Gilmer County Records.
Said property is commonly known as 107 Westwoods Drive, Ellijay, Georgia 30540.
To have and to hold the said bargained premises together with all improvements now situated or hereafter placed thereon, and all interest, right and equity which the party of the first part now or may hereafter have therein to the only proper use, benefit, and behoof of the said party of the second part, its successors, heirs and assigns forever, in fee simple.
The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purposes of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien on the property but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed.
The individual at Copper Basin Federal Credit Union who has full authority to negotiate, amend, and/or modify the terms of this Security Deed is Rhonda Jacobs, 771 Ocoee Street, Copperhill, TN 37317 (706)632-4888.
To the best knowledge and belief of the undersigned, the party in possession of the property is Scottie Edward Sanford or a tenant or tenants.
