STATE OF GEORGIA COUNTY OF FANNIN By virtue of a Power of Sale contained in that certain Security Deed from Jeffrey M. Barriault and Kelly J. Barriault to Copper Basin Federal Credit Union, dated August 5, 2005, filed August 12, 2005, recorded in Deed Book 659, Page 519-532, Fannin County, Georgia records, as may have been modified and/or renewed from time to time including the Loan Modification Agreement between Jeffrey M. Barriault and Kelly J. Barriault to Copper Basin Federal Credit Union dated July 13, 2010, filed July 21, 2010, recorded in Deed Book 934, Page 672-676, Fannin County, Georgia records (hereinafter the Security Deed), the Security Deed being given to secure a Note of even date between Jeffrey M. Barriault and Kelly J. Barriault (borrower) and Copper Basin Federal Credit Union (lender), in the original principal amount of Two Hundred Two Thousand Eight Hundred Forty-Two and 98/100 Dollars ($202,842.98), as may have been modified/renewed from time to time, including the Note dated July 13, 2010, between Jeffrey M. Barriault and Kelly J. Barriault (borrower) and Copper Basin Federal Credit Union (lender) in the modified/renewed principal amount of One Hundred Eight-Five Thousand Three Hundred Eighty-Five and 08/100 Dollars ($185,385.08) (hereinafter Note), with interest thereon as provided therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Fannin County, Georgia, within the legal hours of sale on the first Tuesday in February, 2016, the following described property: T-6448GA All that tract or parcel of land lying and being in the 9th District and 2nd Section of Fannin County, Georgia, and being a part of Land Lot No. 20 and being more particularly described as containing 5.51 acres according to a plat of survey by Lane S. Bishop, Georgia Registered Land Surveyor No. 1575 for Cathy Clark, said recorded plat is in Plat Hanger A-157, page 3, in the Office of the Clerk of Superior Court, Fannin County, Georgia. Subject to existing easements and right of ways for public roads, if any. Also subject to Fannin County, Georgia Subdivision regulations, Mobile Home regulations, and any zoning or other ordinances, if any. This conveyance made together with right of ingress, egress and utility service along existing roads to the subject property. Subject to a Tri-State Electric easement recorded in Book 105, Page 528 in the Office of the Clerk of Superior Court, Fannin County, Georgia. Also conveyed herewith are the mineral rights which were acquired by deed recorded on August 8, 1994 in Deed Book 215, page 566 in the Office of the Clerk of Superior Court, Fannin County, Georgia. This being that same property conveyed unto David W. Collins and Sherry Collins by Warranty Deed with Rights of Survivorship from David W. Collins dated February 27, 1998, recorded on March 4, 1998, in Book 285, Page 268 in the Office of the Clerk of Superior Court, Fannin County, Georgia. BEING AND INTENDED TO BE THAT SAME PROPERTY CONVEYED UNTO Jeffrey M. Barriault and Kelly J. Barriault from David W. Collins and Sherry Collins by Warranty Deed recorded on 1-31-2000 in Book 348, Page 100 in the Office of the Clerk of Superior Court, Fannin County, Georgia. Said property is commonly known as 222 Mountain View Road, McCaysville, Georgia 30555. To have and to hold the said bargained premises together with all improvements now situated or hereafter placed thereon, and all interest, right and equity which the party of the first part now or may hereafter have therein to the only proper use, benefit, and behoof of the said party of the second part, its successors, heirs and assigns forever, in fee simple. The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purposes of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien on the property but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed.
