NOTICE OF SALE UNDER POWER
By virtue of the power of sale contained in that certain deed to secure debt (the "Security Deed") executed by Troy R. Patterson, Robert Brian Patterson and Renita S. Turner to Hattie G. Watson dated February 9, 2000, as recorded in Deed Book 349, Page 179, re-recorded in Deed Book 367, page 714, and assigned to Karen E. Sanders as Trustee of the Hattie G. Watson Trust Dated October 7, 2004 by Assignment recorded in Deed Book 1008, page 268, modified at Deed Book 1008, page 269, in the office of the Clerk of the Superior Court of Fannin County, Georgia, and by virtue of a default in the payment of the indebtedness secured thereby, Karen E. Sanders as Trustee of the Hattie G. Watson Trust Dated October 7, 2004, as attorney in fact for Troy R. Patterson, Robert Brian Patterson and Renita S. Turner, will sell at public outcry before the Courthouse door in Fannin County, Georgia, within the legal hours of sale, for cash, to the highest bidder, on the first Tuesday in February, 2016, the following described property:
All that tract or parcel of land lying and being in part of Land Lot 196, of the 9th District, 2nd Section of Fannin County, Georgia, being 29.09 acres as shown by that certain plat of record in Plat Hanger A-566, page 7, Fannin County, Georgia records (said plat being incorporated herein and made a part hereof by reference for a more complete and accurate metes and bounds description of said property). Subject to those certain easements; rights of way; and restrictions as shown on the aforementioned plat; and as appearing of record. LESS AND EXCEPT that portion of said property released from said security deed by quitclaim deed recorded February 20, 2002, in Deed Book 434, page 62, of said records, more particularly described by plat recorded in Plat Hanger A566, page 7, in the office of the Clerk of the Superior Court of Fannin County, Georgia, which instruments are incorporated herein by reference for a complete description.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of said indebtedness at the times, in the amounts and in the manner provided for in the instrument or instruments evidencing said indebtedness. Said indebtedness remaining in default, this sale will be made for the purpose of paying said indebtedness and all expenses of sale, including without limitation, advertising costs and attorney's fees, all as provided for in said Security Deed.
Said property will be sold subject to any outstanding and unpaid ad valorem taxes (including taxes which are a lien but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record, if any, superior to the Security Deed.
The property described above will be sold as the property of Troy R. Patterson, Robert Brian Patterson and /or Renita S. Turner, and /or Renita Friesen and / or Trilogy Enterprises, Inc., a Georgia corporation, as their interests may appear, who, to the best knowledge, information and belief of the undersigned, are now the owners of the equitable title to said property.
The Property will be sold as-is without recourse against the Holder of the Security Deed and without representation or warranty of any kind with respect thereto.
Holder hereby reserves the right to suspend the foreclosure proceeding at any time prior to the acceptance of a bid and to subsequently resume the foreclosure proceeding at a time of its choosing or to rebid upon failure of a successful bidder to consummate the purchase.
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE BY THE UNDERSIGNED LAW FIRM.
