STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by James E. Burkey and Susan J. Burkey to Mortgage Electronic Registration Systems, Inc. as nominee for United Equity, LLC dated March 24, 2006, and recorded in Deed Book 1955, Page 416, Glynn County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Deutsche Bank National Trust Company, as Trustee for Morgan Stanley ABS Capital I Inc. Trust 2006-WMC2, Mortgage Pass-Through Certificates, Series 2006-WMC2 by Assignment, securing a Note in the original principal amount of $148,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, February 2, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that certain lot, tract, or parcel of land situate, lying and being in the 27th G.M. District, in Glynn County, Georgia, on the south side of the Buck Swamp Road, which is described and identified according to that certain plat of survey of Little Oak Subdivision, by Roger Clinton Purcell, Georgia Registered Surveyor No. 2435, dated July 29, 1997, which is recorded in the Office of the Clerk of Superior Court of Glynn County, Georgia, at Plat Drawer No. 24, Map No. 108, as all of lot number six (6), of said Little Oak Subdivision, which lot contains according to said plat 0.9470 acres.Also expressly conveyed hereby is any and all interest owned, held, or claimed by the first parties in and to that certain "60-foot access easement" which is described and identified on that certain plat of survey for James A. Langford and Shan T. Langford dated May 2, 1995, revised May 11, 1996, by James L. Conine, Georgia registered surveyor No. 1545, which is recorded in the Office of the Clerk of Superior Court of Glynn County, Georgia, at Plat Drawer 23, Map 180.Being the same property which by Deed dated June 1, 1998 and recorded in the Clerk of the Superior Court of Glynn County, State of GA was granted and conveyed by The Hutcheson Company, a Georgia Corporation unto James E. Burkey and Susan J. Burkey in Deed Book No. 0444 at Page 199. Said property is known as 629 Buck Swamp Road, Brunswick, GA 31523, together with all fixtures and personal property attached to and constituting a part of said property, if any.Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.The property is or may be in the possession of James E.
