NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Philip E. Andrew A/K/A Philip E. Andrew, Jr. and Patricia H. Andrew to Bank of America, N.A. dated April 13, 2004, and recorded in Deed Book 1441, Page 366, Glynn County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Ditech Financial LLC by Assignment, securing a Note in the original principal amount of $125,600.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, February 2, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN GLYNN COUNTY, GEORGIA, DESCRIBED AND IDENTIFIED ACCORDING TO A PRINT OF A PLAT OF SURVEY PREPARED BY JOE BILETZSKOV, GA. LAND SURVEYOR NO. 1672 DATED JULY 12, 1984, RECORDED IN THE OFFICE OF THE CLERK OF GLYNN COUNTY SUPERIOR COURT IN PLAT DRAWER 19, FOLIO 966, AND BEING MORE PARTICULARLY DESCRIBED ACCORDING TO A SURVEY PREPARED BY GENE PETTIGREW, GA. REG. LAND SURVEYOR NO. 2094 DATED SEPTEMBER 21, 1987 AS A PORTION OF LOT THIRTY-ONE (31), SECTION ONE (1), AREA "B", BELLE POINT SUBDIVISION, DESCRIBED AS FOLLOWS, TO-WIT; BEGINNING AT A POINT ON THE NORTHERLY LINE OF PLANTATION ROAD, SAID POINT BEING COMMON TO THE SOUTHEASTERN CORNER OF SAID LOT NO. 31 AND THE SOUTHWESTERN CORNER OF LOT NO. 30 IN SAID SECTION ONE, AND FROM SAID BEGINNING POINT RUNNING SOUTH 59 DEGREES, 18 MINUTES WEST FOR A DISTANCE OF 67.95 FEET TO A POINT; THENCE CONTINUING ALONG THE SAID NORTHERLY LINE OF SAID PLANTATION ROAD SOUTH 65 DEGREES, 16 MINUTES WEST FOR A DISTANCE OF 37.05 FEET TO AN IRON PIN WHICH MARKS THE SOUTHWESTERN CORNER OF THE TRACT HEREIN CONVEYED; THENCE, TURNING AND RUNNING NORTH 24 DEGREES, 44 MINUTES WEST FOR A DISTANCE OF 206.00 FEET TO AN IRON PIN WHICH MARKS THE NORTHWESTERLY CORNER OF THE TRACT HEREIN CONVEYED; THENCE, TURNING AND RUNNING NORTH 43 DEGREES, 48 MINUTES EAST FOR A DISTANCE OF 50.00 FEET TO AN IRON PIN WHICH MARKS THE NORTHEASTERLY CORNER OF THE TRACT HEREIN CONVEYED; THENCE, TURNING AND RUNNING SOUTH 39 DEGREES 42 MINUTES EAST FOR A DISTANCE OF 224.86 FEET TO AN IRON PIN WHICH MARKS THE POINT OR PLACE OF BEGINNING. This being the same property conveyed by Jack B. Kite and Ann S. Kite dated July 13, 1984, Recorded in Deed Book 25-B, Page 708, Glynn County, Georgia Records. Said property is known as 510 Plantation Road, Brunswick, GA 31525, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
