NOTICE OF FORECLOSURE SALE GEORGIA, GLYNN COUNTY By virtue of Power of Sale contained in the Commercial Deed to Secure Debt and Security Agreement dated September 27, 2007, recorded on September 28, 2007 in Deed Book 2311, Page 356, et seq. of the Glynn County, Georgia Records from REAL WHITE JACK RABBIT, LLC (collectively, "Grantor" and/or "Borrower") to GWINNETT COMMUNITY BANK ("Grantee" and/or "Lender"), as modified, aforesaid records (the "Security Deed") and Promissory Note, as modified, in the original principal amount of $2,996,616.18, with interest thereon as set forth therein, there will be offered for sale at public outcry to the highest bidder for cash before the Courthouse door of GLYNN COUNTY, GEORGIA, within the legal hours of sale on the first Tuesday in January, 2016, the property known as: ALL that certain lot, tract or parcel of land, lying and being in Glynn County, Georgia according to a survey dated June 21, 2007, under seal of Robert N. Shupe, Georgia Registered Land Surveyor No. 2224, entitled "Expedited Subdivision Plat of: Lots 21A and 22B, Section C, Glyndale Subdivision, total area = 1.979 Acres", and designated thereupon as all of Lot 22B, area = 1.514 acres. Said plat is recorded in the Glynn County Superior Court Clerk's Office in Plat Book 30, Page 187. Reference is made to said plat for all purposes allowed by law. The indebtedness secured by the Security Deed has been declared due and payable by reason of default under the provisions of the Security Deed and the terms of the note or notes secured thereby, and sale will be made for the purpose of applying the proceeds thereof toward expenses of sale, payment of indebtedness and interest thereon, and any balance remaining shall be applied as provided by law. The Property will be sold as the property of REAL WHITE JACK RABBIT, LLC. Notice has been given of intention to enforce provisions for collection of attorney's fees and expenses of foreclosure in accordance with legal requirements and the terms of the above note or notes and Security Deed. The Property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable); any matters which might be disclosed by an accurate survey and inspection of the Property; any assessments, liens, encumbrances, zoning ordinances, restrictions, easements and covenants which continue to be in effect and have priority over the interest of the purchaser at the non-judicial foreclosure sale contemplated by this Notice of Sale and matters of record superior to the Security Deed first set out above.
