NOTICE OF SALE UNDER POWER
GEORGIA, FANNIN COUNTY
By virtue of a Power of Sale contained in that certain Security Deed from Richard Geiger Trust to Branch Banking and Trust Company, dated November 17, 2011, recorded December 8, 2011, in Deed Book 989, Page 585, Fannin County, Georgia Records, said Security Deed having been given to secure a Note of even date in the principal amount of ONE HUNDRED THOUSAND DOLLARS AND NO CENTS ($100,000.00), with interest thereon as provided for therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Fannin County, Georgia, within the legal hours of sale on the first Tuesday in January 2016 by Branch Banking and Trust Company, as Attorney in Fact for Richard Geiger Trust, all property described in said Security Deed including but not limited to the following described property: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN THE 8TH DISTRICT, 1ST SECTION, FANNIN COUNTY, GEORGIA AND BEING A PART OF LAND LOT 288 AND BEING IN THE CITY OF MORGANTON AND BEING MORE PARTICULARLY DESCRIBED AS A PORTION OF TRACT 2 OF THE PATRICIA ROSS ALEXANDER AND SARAH ELIZABETH ALEXANDER PROPERTY CONTAINING 0.89 ACRES OF LAND, MORE OR LESS, AND BEING MORE PARTICULARLY DESCRIBED IN A SURVEY BY SHELLY J. BISHOP, GRLS NO. 2536, FOR GRICE CONSTRUCTION DATED APRIL 18, 2005 AND RECORDED IN PLAT HANGER D-193, PAGE 2, FANNIN COUNTY RECORDS. LESS AND EXCEPT A 10 FOOT BY 35.87 FOOT STRIP CONTAINING THE WELL, AS DESCRIBED IN WARRANTY DEED RECORDED IN DEED BOOK 639, PAGE 207-208; AFORESAID RECORDS. BEING THE SAME PROPERTY CONVEYED FROM SADLER PLUMBING AND CONSTRUCTION, INC. TO SEASONS BANK BY DEED UNDER POWER OF SALE, DATED SEPTEMBER 5, 2006, RECORDED OCTOBER 16, 2006, IN DEED BOOK 751, PAGE 38-39, FANNIN COUNTY, GEORGIA RECORDS. SUBJECT TO ALL EASEMENTS OF RECORD THERETO INCLUDED IN THAT CERTAIN WARRANTY DEED RECORDED IN DEED BOOK 639, PAGE 207; AFORESAID RECORDS. SUBJECT TO A MONTHLY WATER FEE OF $30.00 PER MONTH AS DESCRIBED IN WARRANTY DEED RECORDED IN DEED BOOK 639, PAGE 207; AFORESAID RECORDS. SUBJECT TO AN AGREEMENT TO SPLIT ALL REPAIRS AND MAINTENANCE AGREEMENT FOR THE WELL DESCRIBED IN WARRANTY DEED RECORDED IN DEED BOOK 639, PAGE 207; AFORESAID RECORDS. ALSO CONVEYED HEREIN IS A PERPETUAL EASEMENT FOR INGRESS AND EGRESS TO SAID PROPERTY FROM OLD US HIGHWAY 76 ALONG THE 40 FOOT EASEMENT ROAD AS CONVEYED IN WARRANTY DEED AT DEED BOOK 753, PAGE 458, AND AS FURTHER SHOWN ON NAT AND SURVEY FOR GRICE CONSTRUCTION RECORDED IN PLAT HANGER D-193, PAGE 2, FANNIN COUNTY RECORDS. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to the following items which may affect the title to said property: any superior Security Deeds of record; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed. To the best of the knowledge and belief of the undersigned, the party in possession of the property is Richard Geiger Trust, The Estate of Richard E. Geiger or tenant(s). The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and (2) final confirmation and audit of the status of the loan.
