NOTICE OF SALE UNDER POWER
Under and by virtue of the power of sale contained in a Security Deed from TERRENO ENTERPRISES, LLC to BRANCH BANKING AND TRUST COMPANY, dated November14, 2011, recorded November 15, 2011, in Deed Book 1700, Page 469, Gilmer County, Georgia records; also that certain Assignment of Leases and Rents dated November 14, 2011, recorded in Deed Book 1700, Page 477, Gilmer County, Georgia records, said Security Deed being given to secure a certain indebtedness from TERRENO ENTERPRISES, LLC, with interest thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Gilmer County, Georgia, within the legal hours of sale on the first Tuesday in January, 2016, the following described property:
All that tract or parcel of land lying and being in Land Lot 98, 11th District and 2nd Section, City of East Ellijay, Gilmer County, Georgia, consisting of 2.49 acres, more or less, as shown on plat of survey for Terreno Enterprises, LLC, Attorney's Title Guaranty Fund, Inc. and First American Title Insurance Co., dated October 21, 2011, prepared by Mark E. Chastain, GRLS No. 2718, and recorded in Plat Book 55, Page 11, Gilmer County, Georgia records. Said plat is incorporated herein by reference thereto for a more complete and accurate legal description.
This conveyance is subject to a 30 foot wide roadway Easement as shown on plat of survey for Julio Schwartzman and Beverly A. Schwartzman, prepared by Greer Dover, County Surveyor, Gilmer County, Georgia, said survey being dated August 1993 and recorded in Plat Book 23, Page 74, Gilmer County, Georgia records.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is TERRENO ENTERPRISES, LLC or a tenant or tenants.
