STATE OF GEORGIA COUNTY OF RICHMOND NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. On October 29, 2013, MICHAEL S. STIERWALT, ("Stierwalt"), executed a Renewal Note ("Note") in the original principal sum of $102,086.99, secured by a Deed to Secure Debt and Assignment of Rents ("Deed 1") dated October 20, 2006, payable to Georgia Bank & Trust Company Bank of Augusta ("Georgia Bank"), conveying property described in Exhibit "A" attached, and recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Book 01086, page 1135, a Modification of Deed to Secure Debt ("Modification") dated October 29, 2013, and recorded in aforesaid Clerk's Office in Deed Book 01418, page 0698, and a Deed to Secure Debt and Assignment of Rents dated November 16, 2006, which Deed is recorded in aforesaid Clerk's Office in Deed Book 01092, page 0470 ("Deed 2"). Default has been made in the payment of installments on the Note. Georgia Bank declared the entire unpaid indebtedness due and payable in accordance with the terms of the Note and the same has not been paid. Deeds 1 and 2 and the Modification provide that when the Note secured thereby becomes due and is not paid, that said property may be sold before the Courthouse door of Richmond County, Georgia, upon Georgia Bank first giving notice of the place and terms of such sale (1) time a week for (4) weeks in the newspaper in which the Sheriff's advertisements are published, and where said property is located. NOW THEREFORE, pursuant to the powers contained therein, the property will be sold before the Courthouse door in Richmond County, Georgia, at public outcry on the first Tuesday in January 2016 between the legal hours of sale. Georgia Bank will convey title to the purchaser as attorney-in-fact for Stierwalt. The money derived from the sale will be applied: first to the expenses of said sale; secondly, to the amount due on said Notes; and the balance, if any, shall be paid to Stierwalt. TERMS: Cash, subject to State and County ad valorem taxes or assessment and any federal tax liens of record. Purchaser is to pay for all legal papers and revenue stamps. This 6th day of January 2016. Said property is conveyed subject to any and all easements and restrictions of record. Said property is commonly known as 2207 Tudor Drive, Augusta, Georgia 30906. AND All that lot or parcel of land, together with all buildings and improvements thereon and being in the State of Georgia, County of Richmond, being known and designated as Lot 28, Block "C", of Southland's Subdivision as shown on a plat recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Book 18-P, page 320.
