NOTICE OF SALE UNDER POWER
Because of a default under the terms of the Security Deed executed by Samuel S. Guest to Mortgage Electronic Registration Systems, Inc. as nominee for Taylor, Bean & Whitaker Mortgage Corp. its successors and assigns dated March 19, 2007, and recorded in Deed Book X31, Page 94, Rabun County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. by Assignment, securing a Note in the original principal amount of $481,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, January 5, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
(sic - ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 78, 13th District, Rabun County, Georgia, being mare particularly shown on that plat of survey for Samuel S. Guest, Georgia Power Company Lease Lot #1612, Area 2, dated October 11, 1995, prepared by T. Lamar Edwards, Georgia Registered Land Surveyor No. 1837, being more particularly described as follows:
TO FIND THE TRUE POINT OF BEGINNING, begin at a point found at the intersection of Land Lots 77, 78, 105 and 106; run thence south 26 degrees 46 minutes west, a distance of 2,612.3 feet to an iron pin found and the TRUE POINT OF BEGINNING; thence run along the existing boundary of Nacoochee Lake in a northeasterly and southeasterly direction and following the meanderings thereof along the following traverse lines: north 56 degrees 05 minutes east, a distance of 44.8 feet to a point; north 75 degrees 35 minutes east, a distance of 32.7 feet to a point; south 63 degrees 02 minutes east, a distance of 35.4 fest to a point; south 41 degrees 38 minutes east, a distance of 48.3 feet to point; south 45 degrees 26 minutes east, a distance of 48.2 feet to a point located on the approximate eastern land lot line of Land Lots 78 and western land lot line of Land Lot 105; south 21 degrees 37 minutes east, a distance of 29.7 feet to an iron pin found; thence leaving said existing boundary of Nacoochee Lake run thence south 54 degrees 13 minutes west, a distance of 268.8 feet to an iron pin found; run thence south 76 degrees 06 minutes west, a distance of 116.6 feet to an iron pin found; run thence north 30 degrees 00 minutes east, a distance of 306.7 feet to an iron pin found and the TRUE POINT OF BEGINNING, said property containing .99 acres, more or less.)
ALL THAT CERTAIN PROPERTY SITUATED IN THE CITY OF LAKEMONT, IN THE COUNTY OF RABUN AND STATE OF GEORGIA AND BEING DESCRIBED IN A DEED DATED 04/18/2004 AND RECORDED 06/07/2004 IN BOOK L26, PAGE 120, AMONG THE LAND RECORDS OF THE COUNTY AND STATE SET FORTH ABOVE ANDREFERENCED AS FOLLOWS:
LAND LOT 78, DISTRICT 13, PARCEL ID NUMBER: LN02 018L
Said property is known as 24 Rosebud Ln., Lakemont, GA 30552, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of Samuel S. Guest, successor in interest or tenant(s).
