NOTICE OF SALE UNDER POWER
Under and by virtue of the power of sale contained in a Security Deed from JASON D. OWENS and BILLIE J. OWENS to UNITED COMMUNITY BANK, dated January 17, 2008, recorded January 17, 2008, in Deed Book D33, Page 541, Rabun County, Georgia records, said Security Deed being given to secure a Note from JASON D. OWENS and BILLIE J. OWENS dated January 17, 2008, in the original principal amount of One Hundred Eleven Thousand Two Hundred and 00/100 ($111,200.00) Dollars, with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Rabun County, Georgia, within the legal hours of sale on the first Tuesday in January, 2016, the following described property:
Tract One:
All that tract or parcel of land lying and being in Land Lot 105 of the Second Land District of Rabun County, Georgia and being more particularly described as follows to wit:
For a full and complete description for the real property being hereby conveyed reference is hereby had and made to a plat of survey dated October 23, 1985 and prepared by William F. Rolader, Georgia Registered Land Surveyor No. 2042. The real property being hereby conveyed is a 1.00 acre tract of land. Said plat is of record in plat Book 21, Page 197 in the office of the Clerk of Rabun Superior Court. Reference to said plat and the record thereof is for the express purpose of incorporating herein its description of said 1.00 acre tract of land as depicted thereon.
Also conveyed is the right to use the existing ingress-egress easement shown on said plat and the existing ten (10) foot grated road shown on said plat and the property is conveyed subject to the right of others to also use the easement and road.
Also conveyed herein are the non-exclusive water rights to a spring located on the North side of Marsengill Knob, as set forth in previous deeds.
Said above described 1.00 acre tract of land is conveyed subject to a road right of way easement that was granted on October 27, 1995 form Ronald Clark Hooper and Vickie Lynn Hooper to the William F. Prior and Betty Lou Prior Trust. Said road right of way easement is of record in Deed Book A-16, Page 286 aforesaid records.
Tract Two:
All that tract or parcel of land lying and being in Land Lot 105 of the Second Land District of Rabun County, Georgia and being more particularly described as follows, to wit:
For a full and complete description of the real property being hereby conveyed, reference is hereby had and made to a plat of survey dated August 9, 1988 and prepared by William F. Rolader, Georgia Registered Land Surveyor No. 2042. The real property being hereby conveyed is a 0.238 acre tract of land. Said plat is of record in Plat Book 25, Page 292 in the office of the Clerk of Rabun Superior Court. Reference to said plat and the record thereof is for the express purpose of incorporating herein its description of said 0.238 acre tract of land as depicted thereon.
Also conveyed is a perpetual non-exclusive road right of way easement along that certain forty (40) foot wide road right of way easement (said road is presently existing) and the ten (10) foot wide gravel drive which leads from the same and along the westerly line of said above described real property. Said forty (40) foot wide road right of way easement and said ten (10) foot wide gravel drive are depicted in a plat of survey of record in Plat Book 26, Page 123, aforesaid records. Said road lying within said forty (40) foot wide road easement leads in a northerly direction from said ten (10) foot wide gravel drive to Wolfork road, a public road.
The above described property is conveyed subject to those certain restrictions recorded in Deed Book O-7, Page 237, aforesaid records. Said above described property is also conveyed subject to those portions of the same lying within said ten (10) foot wide road right of way and to all existing easements.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is JASON D. OWENS and BILLIE J. OWENS or a tenant or tenants.
