gpn14 HS Foreclosures STATE OF GEORGIA COUNTY OF LONG NOTICE OF SALE UNDER POWER IN SECURITY DEED Under and by virtue of the power of sale in that certain Deed to Secure Debt from James E. Folker (hereinafter referred to as "Grantor") to The Heritage Bank, ("Grantee"), dated June 4, 1998, and recorded in Deed Book 148, Page 1, Long County, Georgia records, (referred to as the "Security Deed"), said Security Deed having been given to secure a Promissory Note, dated July 21, 2010, in the name of Coastal Forklift and Hydraulics, Inc. in the original principal amount of $1,723,847.03 and a Promissory Note dated March 24, 2010 in the name of Coastal Forklift and Hydraulics, Inc. in the original principal amount of $50,668.50, each with interest from date thereon at the rate specified therein on the unpaid balances until paid, there will be sold by the undersigned at public outcry, during the legal hours of sale before the door of the courthouse of Long County, Georgia, on the first Tuesday in January, 2016, to wit, January 5, 2016, to the highest and best bidder for cash the following described property: All that certain tract or parcel of land situate, lying and being in the 24th G.M.District of Long County, Georgia, containing one (1) acre, more or less, and being more particularly described according to a plat thereof prepared by Herman Parker, GA R.L.S. No. 88, dated May 1, 1972, and recorded in the Office of the Clerk of Long County Superior Court in Plat Book 3, page 199. Reference is hereby made to said plat and the record thereof for all purposes of description. TOGETHER WITH all the improvements erected on the property, and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights and stock, and all fixtures a part of the property, replacements and additions. The indebtedness secured by said Security Deed and Notes has been and is hereby declared due and payable in full because of Grantor's failure to make payment of principal and interest required in the Notes and the Security Deed. Notice has been given of intention to enforce provisions for collection of attorney's fees and of foreclosure in accordance with legal requirements and the terms of the Security Deed and Notes. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Security Deed, accrued interest and expenses of the sale and other sums secured by the Security Deed including attorney's fees, and the remainder, if any, shall be applied as provided by law. To the best knowledge and belief of the undersigned the property will be sold as the property of James E. Folker subject to outstanding ad valorem taxes, street improvements and other superior matters of record if any.
