gpn11 CN6504 NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF CATOOSA Because of default in the payment of the indebtedness secured by a Security Deed executed and delivered by Terry Wilson a/k/a Terry R. Wilson and Marcia Wilson a/k/a Marcia A. Wilson in favor of Vanderbilt Mortgage and Finance, Inc. dated March 20, 2012, in the original principal amount of $39,537.63, and recorded in Book 1612, Page 0351, Catoosa County, Georgia Records, the undersigned, Vanderbilt Mortgage and Finance, Inc., pursuant to the Security Deed and Note thereby secured, has declared the entire amount of said indebtedness due and payable and pursuant to the power of sale contained in the Security Deed, will on the first Tuesday in January, 2015, during the legal hours of sale, at the Courthouse door in Catoosa County, sell at public outcry to the highest bidder for cash, the property described in the Security Deed to-wit: All that tract or parcel of land located in Original land Lot No. 52 in the 27th district and 3rd Section of Catoosa County, Georgia, and described as follows: BEGINNING at an iron stake on the East side of Ringgold Road, 305 feet North of the property of Callaway; thence running East along the North side of a private driveway, a distance of 157 feet to an iron stake; thence running Northerly a distance of 195 feet to an iron stake on the South side of a private driveway; thence running southwesterly along the South side of said private driveway, a distance of 200 feet, more or less, to an iron stake on the East side of said Ringgold Road; thence running South along the East side of said road, a distance of 33 feet, more or less, to an iron stake and point of beginning. Also granted herein is a 20 foot right of way over said private driveway located North of said tract of land as described above for purposes of ingress and egress. BEING all of the same property conveyed to Randall Gaston and wife, Karen Gaston by Warranty Deed from J.T. Quarles dated May 20, 1988 and filed and record in Book 357, Page 497, Clerk's Office for Catoosa County, Georgia. The said Randall Gaston and Karen Gaston are now divorced. By Final Judgment and Decree subject premises was divested out of Karen Gaston and vested in Randall Gaston in Book 74, page 38, Clerk's Office aforesaid. BEING all of the same property conveyed to Marcia Wilson and Terry Wilson by Warranty Deed from Randall Gaston, dated February 10, 2012 and filed of record in Book 1606, Page 3, Clerk's Office for Catoosa County, Georgia. Together with all fixtures and other personal property conveyed by the Security Deed. The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants, restrictions, liens, and other superior matters of record which may affect said property. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed. Notice has been given of intention to collect attorney's fees in accordance with the terms of the note secured by the Security Deed. Notice has been also given, in writing and by certified mail return receipt requested, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the note thereby secured in accordance with O.C.G.A. 44-14-162.2(a). To the best knowledge and belief of the undersigned, the party in possession of the property is Terry Wilson a/k/a Terry R. Wilson and Marcia Wilson a/k/a Marcia A. Wilson or tenant or tenants. The proceeds of said sale will be applied to the payment of said indebtedness and the expense of said sale, all as provided in the Security Deed.
