Be-cause of a de-fault in the pay-ment of the in-debt-ed-ness se-cured by that cer-tain Se-cur-i-ty Deed, dat-ed No-vem-ber 13, 1986, ex-e-cut-ed by JAMES D. MCCRA-NIE TO COL-LAT-ER-AL IN-VEST-MENT COM-PA-NY, record-ed in Deed Book 194, Page 75, Dodge Coun-ty, Geor-gia Deed Records, and se-cur-ing a Note in the origi-nal prin-ci-pal amount of $35,703.00, said Se-cur-i-ty Deed as-sumed by JAMES W. MO-SE-LY AND CLAIRE E. THIS PROP-ER-TY IS SUB-JECT TO THE RE-STRIC-TIONS PLACED ON SAID SUB-DI-VI-SION BY W.L. JES-SUP, JR., AS RECORD-ED IN DEED BOOK 84, PAGE 64-65, AND AMEND-MENTS THERE-TO AS RECORD-ED IN DEED BOOK 103, PAG-ES 311-312, SAID CLERKS OF-FICE.
THE AFORE-DE-SCRIBED REAL PROP-ER-TY IS ALSO KNOWN AS 1415 LO-CUST LN, EAST-MAN, GA 31047, AC-CORD-ING TO THE PRES-ENT SYS-TEM OF NUMBER-ING HOUSES IN DODGE COUN-TY, GEOR-GIA.
This sale will be con-duct-ed sub-ject (1) to con-fir-ma-tion that the sale is not pro-hibi-ted un-der the U.S. Bank-rupt-cy Code and (2) to fin-al con-fir-ma-tion and au-dit as to the amount and sta-tus of the loan with the hold-er of the Se-cur-i-ty Deed, in-clud-ing but not lim-it-ed to, a de-ter-mi-na-tion that the bor-row-er has not re-in-stat-ed the loan pri-or to the fore-clo-sure sale.

Said real prop-er-ty will be sold sub-ject to any out-stand-ing ad valor-em tax-es (in-clud-ing tax-es which are a lien, but not yet due and pay-able), the right of re-demp-tion of any tax-ing au-thor-i-ty, any mat-ters which might be dis-closed by an ac-cu-rate sur-vey and in-spec-tion of the real prop-er-ty, any as-sess-ments, liens, en-cum-branc-es, zon-ing or-di-nanc-es, re-stric-tions, cov-en-ants, and mat-ters of record su-pe-ri-or to the Se-cur-i-ty Deed first set out above.
To the ext-ent that said real prop-er-ty is com-prised of more than one par-cel, said real prop-er-ty will be sold in one or more par-cels and in such or-der as the hold-er of the Se-cur-i-ty Deed may de-ter-mine.
Upon in-for-ma-tion and be-lief, said real prop-er-ty is pre-sent-ly in the pos-ses-sion or con-trol of JAMES W. MO-SE-LY AND CLAIRE E. MO-SE-LY AND/OR JAMES D. MCCRA-NIE and the pro-ceeds of said sale will be ap-plied to the pay-ment of said in-debt-ed-ness and all the ex-pens-es of said sale, in-clud-ing at-tor-neys fees, all as pro-vid-ed in said Se-cur-i-ty Deed and the ex-cess pro-ceeds, if any, will be dis-trib-ut-ed as pro-vid-ed by law.
