NOTICE OF SALE UNDER POWER
GEORGIA, CHATTOOGA COUNTY
Under and by virtue of the Power of Sale contained in a Security Deed given by DEBORAH LEE HYDEN TURNER to SOUTHEAST FIRST NATIONAL BANK, dated August 1, 2008, recorded in Deed Book 550, Page 192, Chattooga County, Georgia Records conveying the after-described property to secure a Note in the original principal amount of Fifty Thousand Eight Hundred Ninety One Dollars and Sixty Cents ($50,891.60), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Chattooga County, Georgia, within the legal hours of sale on the first Tuesday in January, 2016, the following described property:
All that tract or parcel of land lying and being in Land Lot 102 in the 6th District and 4th Section of Chattooga County, Georgia, and being in the Town of Trion, Georgia, and being the lot and land shown as No. 514 upon a plat entitled Section No. 2 of a Subdivision of the Residential Properties of the Trion, Georgia Division of Riegel Textile Corporation by Pickell & Pickell, Engineers, dated February, 1952, recorded in Plat Book 3, Page 11 in the office of the Clerk of Superior Court of Chattooga County, Georgia, reference to which plat is hereby made for a more specific description of said property, which is improved property with a residence erected thereon, and is known as #137 Marsh Avenue under the current system of numbering houses in Town of Trion, Georgia.
The lands described herein were conveyed to Betty Katherine Erwin Hyden (now Garner) under that certain warranty deed from Nelda Sue (Susie) Hankins Haney, dated February 27, 1981, recorded in Deed Book 179, page 619, Chattooga County Deed Records.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made of the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorneys fee (notice of intent to collect attorneys fees having been given). William M. Tutton, P.O. Box 530, Summerville, Georgia, 30747, shall have full authority to negotiate, amend, and modify all terms of said Security Deed and may be reached at (706) 857-3473.
Said property will be sold subject to any outstanding ad valorem taxes (*including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restriction, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is DEBORAH LEE HYDEN TURNER or a tenant or tenants and said property is more commonly know as 24 MARSH AVENUE, TRION, GEORGIA.
