NOTICE OF SALE UNDER POWER
By virtue of the power of sale contained in that certain Deed to Secure Debt executed by SHARON CHESHIRE to SOUTHEAST FEDERAL CREDIT UNION, A CORPORATION EXISTING UNDER THE LAWS OF THE UNITED STATES OF AMERICA, dated December 8, 2007, as recorded in Deed Book 00539, beginning at Page 0177, in the office of the Clerk of the Superior Court of Chattooga County, Georgia (herein the Security Deed), and by virtue of a default in the payment of the indebtedness secured by the Security Deed, JOHN R. DENNIS, as attorney-in-fact for SOUTHEAST FEDERAL CREDIT UNION, A CORPORATION EXISTING UNDER THE LAWS OF THE UNITED STATES OF AMERICA, will sell at public outcry before the Courthouse door in Chattooga County, Georgia, within the legal hours of sale, for cash, to the highest bidder, on the first Tuesday in JANUARY 2016, the following described property:
All that tract or parcel of land situated, lying and being in Land Lot No. 155 of the 13th District, 4th Section, Chattooga County, Georgia and being more particularly described as:
BEGINNING as an established corner on the northwesterly side of the Chelsea Valley Public Road which is 319.7 feet southwesterly measured along said northwesterly side of said road from it intersection with the original lot line forming the north boundary of said land lot; thence along said northwesterly side of said road south 54 degrees West 200 feet, south 55 degrees 30 minutes west 100 feet and south 42 degrees 30 minutes west 180.3 fee to the northwest corner of its intersection with a field road running westerly from said public road; thence along the northerly side of said field road north 81 degrees west 400 feet and south 87 degrees 10 minutes west 95 feet to a woods road, thence with said woods road north 29 degrees 20 minutes east 440 feet to an established corner; thence north 89 degrees east 450 feet and south 60 degrees east 224 feet to the point of beginning; TOGETHER with all improvements thereon, containing 5.18 acres, according to a survey plat thereof by H. L. Campbell, GA R.L.S. No. 1154, dated December 20, 1978; and being the same property conveyed Susan S. Hayes (now Susan A, Stewart) by deed of January 2, 1979, recorded in Chattooga Deed Book 169, Page 188.
And being the same property conveyed to Raymond M. Cheshire and wife, Sharon Cheshire by survivorship deed dated January 9, 1995 and recorded in Deed Book 311, Page 214 in the Office of the Clerk of Superior Court, Chattooga County, Georgia.
Raymond M. Cheshire having died _______ leaving only Sharon Cheshire with an interest in said property.
That debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of said indebtedness at the times, in the amounts and in the manner provided for in the instrument or instruments evidencing said indebtedness, Said indebtedness remaining in default, this sale will be made for the purpose of paying said indebtedness and all expenses of sale, including without limitation, advertising costs and attorneys fees, all as provided for in said security deed.
Said property will be sold subject to any outstanding and unpaid ad valorem taxes (including taxes which are a lien but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record, if any, superior to the Security Deed.
The property described above will be sold as the property of SOUTHEAST FEDERAL CREDIT UNION, A CORPORATION EXISTING UNDER THE LAWS OF THE UNITED STATES OF AMERICA, who, to the best knowledge, information and belief of the undersigned, is now the owner of the equitable titles to said property.
