STATE OF GEORGIA COUNTY OF RICHMOND NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Robert L. Frazier Sr. a/k/a Robert L. Frazier and Bessie Mae Frazier a/k/a Bessie M. Frazier to Fairfield Financial Corporation dated February 12, 1988, and recorded in Deed Book 281, Page 932, Richmond County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. by Assignment, securing a Note in the original principal amount of $30,600.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, January 5, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: ALL that lot, tract or parcel of land, situate, lying and being in the 123rd District, G.M. of Richmond County, Georgia, known and designated as Lot 27, Block C, Section I of Georgetowne South Subdivision as shown on a plat prepared by D. L. Printup, Jr., dated August 25, 1969 and recorded in the Clerk's Office of Richmond Superior Court in Realty Book 37 G, page 348-353, to which reference is made for a more accurate desciption as to the metes, bounds and dimensions of the property herein conveyed. Said property fronts a distance of 80.0 feet on the North side of Chadbourne Street and extends back therefrom between parallel lines a distance of 145.0 feet on its Eastern and Western boundaries to a rear width or Northern boundary of 80.0 feet; Said property IS BOUNDED: SOUTH by Chadbourne Street; EAST by Lot 26, of said block and plat; WEST by Lot 28, of said block and plat: and NORTH by Lot 35, of said block and plat. Said property is conveyed subject to Protective Covenants applicable to said subdivision as the same appear of record in the aforementioned Clerk's Office in Realty Book 37-G, page 341-.347. Said property is known as 3427 Chadbourne St., Augusta, GA 30906, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor. The property is or may be in the possession of Robert L. Frazier, Sr., a/k/a Robert L. Frazier, and Diann D.
