STATE OF GEORGIA COUNTY OF RICHMOND NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Kimberly T. Emory and Howard R. Emory to Mortgage Electronic Registration Systems, Inc. as nominee for Professional Lending, LLC and its successors and assigns dated August 15, 2007, and recorded in Deed Book 1139, Page 2292, Richmond County Records, securing a Note in the original principal amount of $53,165.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, January 5, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that lot, or parcel of land, together with improvements thereon, if any, lying, being and situate in the State of Georgia and County of Richmond, being known and designated as Lot 16 of Block C on a plat of survey by Southern Partners, Inc., recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia in Reel 628, Page 2393, reference being made to said plat for a more complete and accurate description as to metes, bounds, courses, location and distance of said property. Also included in this conveyance is 2003 Fleetwood Hickory Hill Mobile Home, VIN GAFL335A88411HH11 and GAFL335B88411HH11. The Mobile/Manufactured Home Certificates of Permanent Location are recorded in Deed Book 1078, Pages 1714-1716 and Deed Book 1078, Pages 1717-1719, Richmond County Records. Said property is subject to any and all easements and restrictions of record. Said property is known as 1060 Hancock Mill Lane, Hephzibah, GA 30815, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
