NOTICE OF SALE UNDER POWER GEORGIA, McDUFFIE COUNTY By virtue of the power of sale contained in that certain Security Deed from Michael D. Anderson to Queensborough National Bank & Trust Co. dated December 21, 2007, and recorded in Deed Book 6318, pages 220-223, Columbia County, Georgia records, said Security Deed having been given to secure a Note dated December 21, 2007, in the original principal sum of Sixty-One Thousand Nine Hundred Two and 59/100 Dollars ($61,902.59) with interest from date at the rate stated in said Note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder from cash before the Courthouse door in Columbia County, Georgia, within the legal hours of sale on the first Tuesday in January, 2016, the property described on Exhibit "A" attached hereto and incorporated herein by reference. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees. This sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U. S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed. Notice has been given of intention to collect attorney's fees in accordance with the terms of the Note secured by said deed. Notice has also been given, in writing and by certified mail, return receipt requested, to the borrower, of the name, address, and telephone number of the individual or entity who shall have full authority to negotiate, amend, and modify all terms of the Security Deed and the Note thereby secured in accordance with O.C.G.A. Section 44-14-162.2(a). Said property will be sold as the property of Michael D. Anderson, subject to a prior Security Deed in favor of Queensborough National Bank & Trust Co. dated December 21, 2007, recorded in Deed Book 6318, pages 220-223, aforesaid records, to the outstanding ad valorem taxes and/or assessments, if any, and all easements and restrictions of record, if any, having priority over this Security Deed. EXHIBIT "A" PROPERTY DESCRIPTION FOR MICHAEL ANDERSON ALL that tract of parcel of land, with improvements thereon, situate, lying and being in the 129th District, G.M. of Columbia County, Georgia, containing 210.37 acres, more or less, and bounded now or formerly, as follows: On the North by Wrightsboro Road; on the East by lot of Angela A. Ashcraft, Clary's Cut Road, property of Cedar Grove Church and property formerly of W. T. Crawford, now of Herman Gay; on the South by property formerly of Jim Evans and property formerly of Gene Bailey, now of Robert Pollard; and on the West by property of Robert Cason and property formerly of the Estate of Edward B. Anderson, now Maggie Anderson. LESS AND EXCEPT All that lot or parcel of land, situate, lying and being in Columbia County, Georgia, containing 3.10 acres, and being more particularly described by Plat of Survey thereof prepared by John M. LESS AND EXCEPT All that tract, parcel or lot of land, with improvements thereon, situate, lying and being in the State of Georgia, County of Columbia, lying and being in the 129th G.M.D., containing 3.70 acres, as shown on a plat thereof recorded simultaneously herewith in the Office of the Clerk of the Superior Court of Columbia County, Georgia in Plat Cabinet E, Slide 150 #6. Reference is hereby made to said plat for a more complete and accurate description as to the exact metes, bounds, distances, courses and location of said property. LESS AND EXCEPT All that tract or parcel of land, with any improvements thereon, situate, lying and being in the 128th GMD, Columbia County, Georgia, containing 3.63 acres, more or less, and being more particularly described by Plat of Survey thereof prepared by Harris & Assoc. RLS Number 1769, dated July 15, 2005, a copy of which is recorded in Plat Cabinet E, Slide 159 #1 in the Office of the Clerk of Superior Court of Columbia County, Georgia, and to which Plat and the official record thereof reference is hereby specifically made in aid of and for a more complete and detailed description of said tract as to its courses, bounds, metes and distances. LESS AND EXCEPT All that lot or parcel of land with improvements thereon, situate, lying and being in the State of Georgia, County of Columbia, shown as Tract "B" containing 17.22 acres as more particularly shown on a plat prepared for Michael D. Anderson, by Harriss & Associates Land Surveyors dated July 13, 2009. Said plat is recorded simultaneously herewith in the Office of the Clerk of Superior Court in Plat Cabinet G, Slide 27 #4. Reference is hereby made to said plat for a more accurate and complete description as to the metes, bounds and distances of the subject property.
