gpn11 NOTICE OF SALEUNDER POWER GEORGIA, COLQUITT COUNTY THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by RANDALL C. WARD AND REGINA WILLIAMS to TIFTON BANKING COMPANY dated November 14, 2008, recorded in Deed Book 1025, Page 11 and The Federal Deposit Insurance Corporation having been appointed as Receiver of Tifton Banking Company on November 12, 2010, the FDIC having assigned said Security Deed to Ameris Bank by Assignment recorded in Deed Book 1123, Page 352 and last modified by Modification recorded in Deed Book 1200, Page 257, Colquitt County, Georgia Records, conveying the after-described property to secure a Note in the amount of Twenty-Five Thousand Two Hundred Fifteen Dollars and 78/100 ($25,215.78) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Colquitt County, Georgia, within the legal hours of sale on the first Tuesday in January, 2016, the following described property: TRACT 1: All that piece, parcel or tract of land situate, lying and being in Land Lot Number 339, in the 8th Land District of Colquitt County, Georgia, being more particularly described as follows: 2.10 acres, more or less, of Land Lot Number 339 located in the 8th Land District of Colquitt County, Georgia more particularly described on a plat of survey thereof dated November 3, 2008, prepared by Daniel L. Hinson, Georgia Registered Land Surveyor and recorded in Plat Book 41, Page 117A, Colquitt County Records, which said plat and the record thereof are incorporated herein by reference. TRACT 2: All that piece, parcel or tract of land situate, lying and being 1.00 acres, more or less, located in Land Lot 339 of the 8th Land District of Colquitt County, Georgia being more particularly described as Tract 1 on a plat of survey dated January 23, 2007, prepared by Daniel L. Hinson, Georgia Registered Land Surveyor and recorded in Plat Book 40, Page 70B, Colquitt County Records, which said plat and the record thereof are incorporated herein by reference. ALSO INCLUDED HEREIN is a perpetual non-exclusive thirty foot (30') easement for ingress to and from Harper Road to Tract 1 set forth in Plat Book 40, Page 70B, Colquitt County land records. The said easement is shown on Plat Book 40, Page 70B by dotted lines from Harper Road extending to and abutting the said Tract 1, said plat being dated January 23, 2007, and recorded in Plat Book 40, Page 70B, Colquitt County land records, which said plat and the record thereof are incorporated herein by reference. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in said Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
