HANCOCK to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR SUNTRUST MORTGAGE, INC., dated MAY 10, 2007, and recorded on MAY 11, 2007, in DEED BOOK 1368, PAGE 52, of the CATOOSA County, Georgia Records; as last assigned to GREEN TREE SERVICING LLC NKA DITECH FINANCIAL LLC, by Assignment dated DECEMBER 10, 2013, and recorded on DECEMBER 16, 2013, recorded at DEED BOOK 1709, PAGE 134, aforesaid records; conveying the after-described property to secure a Note in the original principal amount of FIFTY TWO THOUSAND Dollars and 00/100 ($52,000.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of CATOOSA County, Georgia, within the legal hours of sale on the first TUESDAY in JANUARY 2016, the following described property: All that tract or parcel of land lying and being in Original Land Lot 24 in the 9th District and 4th Section of Catoosa County, Georgia, being known and designated as Lot Sixty (60) Unit Two (2) Waverly Park Subdivision, as shown by plat of said subdivision of record in Plat Book 6, Page 195, in the Office of the Clerk of the Superior Court of Catoosa County, Georgia. For prior title see deed to Margaret O. Evans recorded February 27, 1990 in Deed Book 384, Page 398 in said clerks office. THIS CONVEYENCE IS MADE SUBJECT TO THE FOLLOWING EXCEPTIONS: Any governmental zoning and/or subdivision ordinance or regulation in effect thereon. The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, non-payment of the monthly installments as required by said Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorneys fees having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
