STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from JAMES H. RUSSELL, SR. to FIRST GEORGIA BANK N/K/A UNITED COMMUNITY BANK, dated January 26, 2000, recorded January 28, 2000, in Deed Book 646, Page 390, Glynn County, Georgia records, as last modified by Modification of Security Deed dated March 12, 2012, recorded in Deed Book 2975, Page 496, Glynn County, Georgia records; also that certain Assignment of Rents dated March 12, 2012, recorded in Deed Book 2975, Page 491, Glynn County, Georgia records, said Security Deed being given to secure a Note from JAMES H. RUSSELL, SR. dated March 12, 2012, in the original principal amount of Twenty Four Thousand Six Hundred Ninety Two and 32/100 ($24,692.32) Dollars, with interest due thereon per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Glynn County, Georgia, within the legal hours of sale on the first Tuesday in January, 2016, the following described property: All that certain lot, tract or parcel of land situate, lying and being in the City of Brunswick, Glynn County, Georgia, identified and described according to the well known maps and plan of said city as the Southeastern One Fourth of Town Commons Lot Numbered Eighty-One (81), between Amherst and Albany Street, being forty five by ninety (45x90) feet in dimensions, and more particularly identified and described as follows, to-wit: beginning at the point of intersection of the Northerly line of P Street with the Westerly line of Amherst Street and running thence Westerly along the said Northerly line of P Street for a distance of 90 feet; thence at right angles to said last described line running Northerly for a distance of 45 feet; thence at right angles to said last described line running Easterly for a distance of 90 feet to the Westerly line of Amherst Street; thence at right angles to said last described line running Southerly along the said Westerly line of Amherst Street for a distance of 45 feet to the point or place of beginning of the land herein conveyed. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is JAMES H. RUSSELL, SR. or a tenant or tenants.
