NOTICE OF SALE UNDER POWER GEORGIA, COWETA COUNTY THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Florence Walker, Willie F Walker to People`s Choice Home Loan, Inc., a Wyoming corporation , dated 12/28/2000, recorded in Deed Book 1602, Page 271, Coweta County, Georgia records, as last transferred to Wells Fargo Bank, National Association, successor by merger to Wells Fargo Bank Minnesota, N.A., as Trustee for Asset Backed Securities Corporation Home Equity Loan Trust, Series 2001-HE1, Asset Backed Pass-Through Certificates, Series 2001-HE1 by assignment recorded or to be recorded in the Coweta County, Georgia records conveying the after-described property to secure a Note in the original principal amount of One Hundred Thirty-Six Thousand and 00/100 DOLLARS ($136,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Coweta County, Georgia, within the legal hours of sale on the first Tuesday in January 2016, the following described property: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 11 OF THE 5TH DISTRICT OF COWETA COUNTY, GEORGIA, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE POINT OF INTERSECTION OF A BRICK WALL LOCATED ON THE NORTH SIDE OF SALBIDE AVENUE WITH A WALL LOCATED ON THE WEST SIDE OF ROBINSON STREET, SAID POINT ALSO BEING THE SOUTHEAST CORNER OF PROPERTY OF MRS. NINA KERSEY, SAID POINT BEING MORE PARTICULARLY IDENTIFIED ON A PLAT PREPARED BY JOHN R. CHRISTOPHER, REGISTERED LAND SURVEYOR, DATED JANUARY 28, 1974, BEING MORE PARTICULARLY IDENTIFIED BELOW FROM SAID POINT; RUN THENCE NORTH 6 DEGREES 45 MINUTES EAST 56 FEET TO A NAIL SET IN ASPHALT, SAID NAIL BEING THE POINT OF BEGINNING OF THE HEREINAFTER DESCRIBED PROPERTY AND FROM SAID BEGINNING POINT; RUN THENCE NORTH 6 DEGREES 45 MINUTES EAST ALONG THE WESTERLY SIDE OF ROBINSON STREET 91 FEET TO AN IRON PIN SET; THENCE NORTH 85 DEGREES 32 MINUTES 40 SECONDS WEST 209 FEET TO AN IRON PIN SET; THENCE SOUTH 5 DEGREES 52 MINUTES WEST 37 FEET TO AN IRON PIN SET; THENCE SOUTH 84 DEGREES 00 MINUTES EAST 50 FEET TO AN IRON PIN SET; THENCE SOUTH 6 DEGREES 00 MINUTES WEST 64 FEET TO AN IRON PIN SET; THENCE SOUTH 89 DEGREES 40 MINUTES EAST 158.4 FEET TO A NAIL SET IN ASPHALT AND THE POINT OF BEGINNING. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument. To the best knowledge and belief of the undersigned, the parties in possession of the property are Florence Walker, Willie F Walker or a tenant or tenants and said property is more commonly known as 19 Robinson Street, Newnan, GA 30263. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
