STATE OF GEORGIA COUNTY OF RICHMOND NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Lisa A. Beauchamp to Wells Fargo Bank, N.A. dated April 2, 2010, and recorded in Deed Book 1254, Page 2064, and Deed Book 1458, Page 1639, Richmond County Records, securing a Note in the original principal amount of $49,094.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, December 1, 2015, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: ALL THAT CERTAIN CONDOMINIUM APARTMENT PROPERTY, located in the State of Georgia, County of Richmond, City of Augusta, being shown and designated as Apartment C, Building Number 8, as shown on four certain plats of Country Club Hills, made by Baldwin & Cranston Associates, Inc., dated February 18, 1969, the first of said plats showing the location of buildings and facilities located upon the property hereinafter described, is recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Book 36-P, Pages 281-286, said plat being entitled "Sheet 1 of 4 Sheets; the remaining three plats showing the floor plans of each apartment located in each of such buildings located on said premises are recorded in said Clerk's Office in Realty Book 36-P, Pages 287-304; said plats being entitled "Sheets 2, 3, and 4 of 4 sheets", as amended by plat recorded in said Clerk's Office in Realty Book 37-S, Pages 400-419, and an said plats being recorded in the Clerk's office in accordance with the provision contained in Chapter 85-16B of the Code of Georgia of 1933, as amended; together with all the right, title and interest in and to the garage Number 8-C, as shown upon the plat first aforesaid, designated as "Sheet 1 of 4", specific reference being made to said plat for a more complete and accurate description of said property, its exact location, dimensions, metes and bounds, including all fixtures attached to or located in said apartment. TOGETHER with a 1/80 undivided interest in and to the parcel of land and space, amenities and facilities, as defined in Section 85-1603B of Chapter 16B of the Code of Georgia: as amended, described on "Sheet 1 of 4 Sheets", and bounded as follows: North by Pike's Alley, East by Southeast by Milledge Road; South by Overton Road; and West by Brookside Road; SAVING AND EXCEPTION THEREFROM, however, those 79 condominium apartment units as shown on said plats, other than the apartment unit herein described, a 1/80 undivided interest, in common with the owners of the other apartments located upon said premises, in and to all utility lines, heating equipment, furnaces, common hallways, and passageways and other similar amenities located upon said premises is included. THE ABOVE DESCRIBED PROPERTY is conveyed subject to all terms and conditions contained in a certain Condominium Declaration applicable to County Club Apartments, dated May 18, 1970, and recorded in said Clerk's Office in Realty Book 37-S, Pages 381-399, amended in Realty Book 38-J, Pages 152-174, and Protective and Restrictive Covenants applicable to Country Club Apartments, as well as easement to Georgia Power Company recorded in Realty Book 16-Z, Page 542, and to any and all other easements, restrictions and covenants of record. THE ABOVE DESCRIBED PROPERTY is convoyed subject to all terms arid conditions contained in a certain Condominium Declaration applicable to County Club Apartments, dated May 18, 1970, and recorded in said Clerk's Office in Realty Book 37-S, Pages 381-399, amended in Realty Book 384, Pages 152-174, and Protective and Restrictive Covenants applicable to Country Club Apartments, as well as easement to Georgia Power Company recorded in Realty Book 16-Z, Page 542, and to any and all other easements, restrictions and covenants of record. Said property is known as 501 Milledge Road 8C, Augusta, GA 30904, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
